Commissioner Lawrence moved that the following Resolution be adopted:

BEFORE THE BOARD OF COUNTY COMMISSIONERS

OF THE COUNTY OF JEFFERSON

STATE OF COLORADO

RESOLUTION NO. CC00-002

Purpose: Rezoning to allow single family residential uses

Approximate Area: 71.77 Acres

WHEREAS, Gregory and Eva White did file an application with the Planning and Zoning Department of Jefferson County to rezone the herein described property in Jefferson County from Agricultural-Two Zone District to Planned Development Zone District; and

WHEREAS, a public hearing was held by the Jefferson County Planning Commission on November 17, 1999, at which time the Planning Commission did, by formal resolution, recommend denial of the subject rezoning application; and

WHEREAS, after notice as provided by law, a public hearing was held by this Board on December 7, 1999; and

WHEREAS, based on the study of the Comprehensive Plan, recommendations of the Jefferson County Planning Commission, comments of the Jefferson County Planning and Zoning Department, comments of public officials and agencies, and testimony and written comments from all interested parties, this Board finds as follows:

1. That proper posting, publication and public notice were provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners of Jefferson County.

2. That the hearings before the Planning Commission and the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at those hearings.

3. That, as conditioned below, the proposal is in substantial conformance with the Evergreen Area Community Plan because it meets Plan recommendations regarding housing, visual resources, hazards, wildlife, water quality and quantity, and services.

4. That, as conditioned below, the proposed use is compatible with existing and allowable land uses in the surrounding area in all directions because surrounding uses are single family residences on lots of two to ten acres and the Official Development Plan provides development standards that will ensure that the character of the area is preserved.

5. The subject property is served by the Elk Creek Fire Protection District.

6. No known commercial mineral deposits exist upon the subject property.

7. That for the above stated reasons, as conditioned below, the applied for rezoning is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the residents of Jefferson County.

8. That each of the factors set forth above is adequate independently to support this resolution.

NOW, THEREFORE, BE IT RESOLVED that Rezoning Application Case No. 97015204RZP1 to amend Jefferson County Zoning Map No. 217 to rezone the Agricultural-Two Zone District to Planned Development Zone District for the following described unincorporated area of Jefferson County, be and hereby is APPROVED subject to the following conditions.

a. The maximum number of lots shall be nine (9). The Official Development Plan shall be revised to include this limitation prior to preparation of a mylar for recording.

b. The applicant shall study installation by the applicant of acceleration/ deceleration lanes on Shadow Mountain Drive where the driveway for the proposed development meets Shadow Mountain Drive. If staff finds that acceleration/deceleration lanes are desirable for intersection safety, the applicant shall be required to include the improvements on the plat.

c. The applicant shall study sight line improvement for the intersection of the driveway for the proposed development with Shadow Mountain Drive. If staff finds that sight line improvement is desirable for intersection safety, the applicant shall be required to include the improvement on the plat.

d. The applicant shall locate wells and septic fields on the plat such that there is a minimum distance of 250 feet between any well and any septic field, whether on-site or off-site, and such that there is a minimum distance of 600 feet between any proposed on-site well and any existing off-site well.

e. As the applicant proposed to the Board of County Commissioners, the applicant shall establish a plan for monitoring and management of septic systems and shall obtain approval of such plan from staff prior to platting.

f. Revision to the Official Development Plan in accordance with the red-marked print dated November 17, 1999 prior to the preparation of a mylar for recording.

Commissioner Sheehan seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:
