Commissioner Lawrence moved that the following Resolution be adopted:

OF THE COUNTY OF JEFFERSON
STATE OF COLORADO
RESOLUTION NO. CC00-053

Applicant: JEFFERSON COUNTY INITIATED

Location: COUNTY-WIDE

Purpose: TO REVISE THE ZONING RESOLUTION CONCERNING REZONING AND SPECIAL USE PROCEDURES

WHEREAS, the Planning and Zoning Department of Jefferson County has proposed to revise the Zoning Resolution concerning the pre-application meeting, the community meeting, and other aspects of the County's rezoning and special use procedures; and

WHEREAS, a public hearing was held by the Jefferson County Planning Commission on August 5, 1998, at which time the Planning Commission did, by formal resolution, recommend approval of the proposed revisions with a condition; and

WHEREAS, after notice as provided by law, a public hearing was held by this Board on January 18, 2000, January 25, 2000 and continued to February 22, 2000 for decision only; and

WHEREAS, based on the evidence, testimony, exhibits, recommendations of the Jefferson County Planning Commission, recommendations of the Jefferson County Planning and Zoning Department, comments of public officials and agencies, and comments from all interested parties, this Board finds as follows:

1. That proper posting, publication and public notice were provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners of Jefferson County.

2. That the hearings before the Planning Commission and the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted, and that all interested parties were heard at those hearings.

3. That the revisions to the Zoning Resolution will clarify, update, streamline, and otherwise improve the County's rezoning and special use procedures, and

4. That the revisions to the Zoning Resolution will improve predictability of the rezoning and special use process; and

5. That it is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the residents of Jefferson County to adopt the revisions to the Zoning Resolution.

6. That each of the factors set forth above is adequate independently to support this resolution.

NOW, THEREFORE, BE IT RESOLVED that the amendments to the Jefferson County Zoning Resolution as set forth in Exhibit "A" attached hereto and incorporated herein by reference be and hereby are APPROVED. The amendments shall apply to all rezoning and special use applications filed with the Planning and Zoning Department on or after March 1, 2000.

Commissioner Holloway seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

The Resolution was adopted by unanimous vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
