Commissioner Lawrence moved that the following Resolution be adopted:

OF THE COUNTY OF JEFFERSON
STATE OF COLORADO
RESOLUTION NO. CC00-073

Applicant: JEFFERSON COUNTY INITIATED
Location: COUNTY-WIDE
Purpose: TO REVISE THE ZONING RESOLUTION CONCERNING REGISTERED SEX OFFENDERS
WHEREAS, the Planning and Zoning Department of Jefferson County has proposed to revise the Zoning Resolution concerning the housing of registered sex offenders in unincorporated Jefferson County; and
WHEREAS, a public hearing was held by the Jefferson County Planning Commission on January 12 and January 15, 2000, at which time the Planning Commission did, by formal resolution, recommend approval of the proposed revisions with a condition; and
WHEREAS, after notice as provided by law, a public hearing was held by this Board on January 25, 2000; and
WHEREAS, based on the evidence, testimony, exhibits, recommendations of the Jefferson County Planning Commission, recommendations of the Jefferson County Planning and Zoning Department, comments of public officials and agencies, and comments from all interested parties, this Board finds as follows:
1. That proper posting, publication and public notice were provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners of Jefferson County.

2. That the hearings before the Planning Commission and the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted, and that all interested parties were heard at those hearings.
3. The General Assembly has recognized the potential danger of sex offenders by stating that it recognizes that some sex offenders cannot or will not respond to treatment. Sex offenders potentially pose a direct threat to the health, safety and welfare of others, as recognized by the General Assembly and the evidence presented to this Board.
4. A concentration of sex offenders in a residential neighborhood increases the potential risk of the threat to the public health and safety.
5. The proposed regulations allow for the housing and treatment of registered sex offenders within any zone district in unincorporated Jefferson County provided the location and any associated impacts are reviewed and approved through the Special Use process.
6. The proposed regulations achieve a reasonable balance between the need to provide suitable housing and treatment programs for sex offenders with the need to protect the health, safety and welfare of the citizens of the County.
7. That it is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the residents of Jefferson County to adopt the revisions to the Zoning Resolution.
8. That each of the factors set forth above is adequate independently to support this resolution.
NOW, THEREFORE, BE IT RESOLVED that the amendments to the Jefferson County Zoning Resolution as set forth in Exhibit "A" attached hereto and incorporated herein by reference be and hereby are APPROVED.
Commissioner Holloway seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

The Resolution was adopted by unanimous vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
