Commissioner Holloway moved that the following Resolution be adopted:
BEFORE THE BOARD OF COUNTY COMMISSIONERS
OF THE COUNTY OF JEFFERSON
STATE OF COLORADO
RESOLUTION NO. CC00-086
Case No. 99015271SUP1 Map No. 47
Applicant: Community in Christ Lutheran Brethren Church
Location: 12229 West 80th Avenue
(Section 29, Township 2 South, Range 69 West)
Zoning: Agricultural-Two
Purpose: Special use to allow low-powered telecommunication facilities
Approximate Area: 4.8 Acres
WHEREAS, Community in Christ Lutheran Brethren Church filed a Special Use application to allow location of a low power telecommunications facility on an existing building; and
WHEREAS, a public hearing was held by the Jefferson County Planning Commission on January 19, 2000, at which time the Planning Commission did, by formal resolution, recommend approval of the subject Special Use application with a condition; and
WHEREAS, after notice as provided by law, a public hearing was held by this Board on February 8, 2000; and
WHEREAS, based on the study of the Comprehensive Plan, recommendations of the Jefferson County Planning Commission, recommendations of the Jefferson County Planning and Zoning Department, comments of public officials and agencies, and testimony and written comments from all interested parties, this Board finds as follows:
1. That proper posting, publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners of Jefferson County.

2. That the hearings before the Planning Commission and the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at those hearings.
3. That the proposal is in substantial conformance with the Jefferson County Zoning Resolution Special Use Criteria and the Telecommunication Land Use Plan because all applicable requirements have been met.
4. That the special use is compatible with existing and allowable land uses in the surrounding area in all directions because the new steeple structure will match the existing architecture of the church and the proposed low power telecommunications facility will be concealed within the steeple design.
5. That no known commercial mineral deposits exist upon the subject property.
6. The subject property is served by the Arvada Fire Protection District.
7. That for the above stated reasons, the applied for Special Use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the residents of Jefferson County.
8. That each of the factors set forth above is adequate independently to support this resolution.
NOW, THEREFORE, BE IT RESOLVED that the Special Use application, Case No. 99015271SUP1, to allow a low-powered telecommunications facility for the following described unincorporated area of Jefferson County be and hereby is APPROVED subject to the following condition:
a. Revisions to the Special Use Written Restrictions as per the red-marked print dated October 26, 1999, prior to preparation of a Mylar for recordation.

Commissioner Lawrence seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:
