Commissioner Lawrence moved that the following Resolution be adopted:

BEFORE THE BOARD OF COUNTY COMMISSIONERS

OF THE COUNTY OF JEFFERSON

STATE OF COLORADO

RESOLUTION NO. CC00-280

RE: COMMUNITY RESOURCES - OPEN SPACE - BELMAR PARK/PS/YOUNG & BINARD/LAKEWOOD OS99-031

Resolved that the Board of County Commissioners hereby approves the recommendation made in the Open Space Advisory Committee Resolution Number
18-00 and authorize the expenditure of $181,333, plus transaction costs, for the acquisition of 1.91 acres, more or less, which is the subject of agreements between the city of Lakewood, Young and Binard.

Authorization for: 1) the Chairman of the Board or Assistant County Attorney, Steve Snyder to accept the Deeds from the city of Lakewood; 2) the Chairman of the Board to execute a Commissioner Deed(s) conveying the property to the city of Lakewood with the Open Space reverter clause; 3) the County Attorney's Office to cause said deed(s) or documents to be recorded in the office of the Clerk and Recorder of Jefferson County; 4) Jefferson County to reimburse the purchase price, costs for the survey, appraisal, title commitment and the environmental site assessment from the city of Lakewood's allocation of Open Space Bond Funds; 5) Jefferson County to pay Colorado Open Lands a transaction fee of 3% of the $181,333 purchase price from the city of Lakewood's allocation of Open Space Bonds; 6) the Treasurer or his designee to make an electronic payment for the reimbursement of the purchase price and associated costs using specific payment delivery instructions to be provided by the Director of Accounting; and 7) the Treasurer or his designee to pay the transaction fee to Colorado Open Lands using specific payment delivery instructions to be provided by the Director of Accounting.

Commissioner Holloway seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

The Resolution was adopted by unanimous vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
