Commissioner Lawrence moved that the following Resolution be adopted:

BEFORE THE BOARD OF COUNTY COMMISSIONERS

OF THE COUNTY OF JEFFERSON

STATE OF COLORADO

RESOLUTION NO. CC00-359

RE: COMMUNITY RESOURCES - OPEN SPACE - TANOA TRACT A/JEFFCO/TANOA HOA/LAND EXCHANGE/OS98-027

Resolved that the Board of County Commissioners hereby approves approve the recommendation made in the Open Space Advisory Committee Resolution Number 24-99 and authorize the execution of the Easement Agreement, Trail Agreement and Commissioners Deed between Jefferson County and the Tanoa Homeowners Association to exchange County property for an interest in Tanoa HOA property for the development of the Highway 74 trail between Elk Meadows Park and Lewis Ridge Road.

Authorization for: 1) the Chairman of the Board to execute the Easement Agreement and all related documents; 2) that under this Resolution, the Board of County Commissioners exempt from the definition of the term "subdivision", as used in C.R.S. 30-28-101(10)(a), the division of land created by the execution of the Commissioner's Deed, based on the determination that such division is not within the purposes of Part 1, Article 28, Title 30, C.R.S., and that the Board of County Commissioners further waives any and all applicable County regulations generally utilized to render this determination; 3) the Chairman of the Board to execute a Commissioner's Deed conveying the property to the Tanoa HOA with the Open Space reverter clause; 4) the Chairman of the Board to execute the Trail Agreement; 5) the Chairman of the Board or Assistant County Attorney, Anne Kelson to accept the documents when received; and 6) the County Attorney's Office to cause said Easement Agreement, Trail Agreement and Commissioner's Deed to be recorded in the office of the Clerk and Recorder of Jefferson County.

Commissioner Holloway seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

The Resolution was adopted by unanimous vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
