Commissioner Holloway moved that the following Resolution be adopted:

RESOLUTION NO. CC00-399

Purpose: Preliminary Plat 9 single family residential lots
Approximate Area: 34.9 Acres
WHEREAS, Mystic Ridge LLC filed an application with the Planning and Zoning Department of Jefferson County to preliminarily plat the herein described property in Jefferson County; and
WHEREAS, a public hearing was held by the Jefferson County Planning Commission on May 24, 2000, at which time the Planning Commission, by formal resolution, recommended approval of the preliminary plat subject to three conditions; and
WHEREAS, the applicant appealed to this Board one of the Planning Commission's conditions of approval, the condition requiring that "No development shall allow rooflines to exceed above the ridgeline"; and
WHEREAS, after notice as provided by law, a public hearing was held by this Board on July 11, 2000, which hearing was continued for decision only to July 25, 2000; and
WHEREAS, based on the study of the Jefferson County Land Development Regulation, recommendations of the Jefferson County Planning Commission, recommendations of the Jefferson County Planning and Zoning Department, comments of public officials and agencies, and testimony and written comments from all interested parties, this Board finds as follows:

1. That proper posting, publication and public notice were provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners of Jefferson County.
2. That the hearings before the Planning Commission and the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at those hearings.
3. That the subject parcel is adjacent to, and largely visible from, Elk Meadow Open Space as well as existing homes and that the applicant proposes to place lot lines, building envelopes, and buildings on the property in such a way that the roofline of one or more buildings would protrude above the ridgeline. The applicant has failed to show it can adequately screen or buffer the ridgeline development, with the use of landscaping or otherwise.
4. That the Planning Commission's condition of approval is supported by several provisions of Part II of the Jefferson County Land Development Regulation, including section 1.1.4 (all lot lines shall be located, when practicable, at the top of slopes, along benches and/or the flow lines of drainage courses), section 12.2 (building envelopes shall be oriented away or buffered from conflicting land uses), and section 13.2 (vegetation shall be supplemented by landscaping to buffer and screen adjacent land uses, enhance the appearance of the property, buffer man-made structures on the property where necessary, present a streetscape or other perimeter landscape treatment that will be compatible with the surrounding community).
NOW, THEREFORE, BE IT RESOLVED that Case No. 98015184APP1 to appeal a condition of approval of the preliminary plat for the following described unincorporated area of Jefferson County, be and hereby is DENIED.
