Commissioner Lawrence moved that the following Resolution be adopted:

BEFORE THE BOARD OF COUNTY COMMISSIONERS

OF THE COUNTY OF JEFFERSON

STATE OF COLORADO

RESOLUTION NO. CC00-415

RE: COMMUNITY RESOURCES - OPEN SPACE - LEYDEN LAKE/PN/ARVADA/HAYES OS99-058

Resolved that the Board of County Commissioners hereby approves the recommendation made in the Open Space Advisory Committee Resolution Number 23-00 and authorize the expenditure of $720,000 plus transaction costs, for the acquisition of 21.538 acres, more or less, which is the subject of an Agreement between the city of Arvada, and Hayes, Et al..

Authorization for: 1) the Chairman of the Board or Assistant County Attorney, Anne Kelson to accept the Deed(s) from the city of Arvada; 2) the Chairman of the Board to execute a Commissioners Deed(s) conveying the property to the city of Arvada with the Open Space reverter clause; 3) the County Attorney's Office to cause said deed(s) or other documents to be recorded in the office of the Clerk and Recorder of Jefferson County; 4) the cost of the acquisition, including purchase price, closing costs, appraisal, survey, environmental site assessment and title policy to be funded from the city of Arvada's allocation of Jefferson County Bond Funds; and 5) the Treasurer or his designee to make an electronic payment for the purchase price and transaction costs, using specific payment delivery instructions to be provided by the Director of Accounting.

Commissioner Holloway seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

The Resolution was adopted by unanimous vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
