Commissioner Holloway moved that the following Resolution be adopted:

BEFORE THE BOARD OF COUNTY COMMISSIONERS

OF THE COUNTY OF JEFFERSON

STATE OF COLORADO

RESOLUTION NO. CC00-430

RE: COMMUNITY RESOURCES - OPEN SPACE - ESSER/WHITLOCK/PC/LAKEWOOD OS99-061

Resolved, that the Board of County Commissioners hereby approves the recommendation made in the Open Space Advisory Committee Resolution Number
33-00 and authorize the reimbursement of a portion of the purchase price in the amount of $530,000, plus the costs of appraisal, survey, environmental site assessment, title policy and closing fee to the City of Lakewood for their acquisition of 0.55 acres, more or less, that was the subject of an Agreement between the City of Lakewood and Betty Esser.

Authorization for: 1) the Chairman of the Board or Assistant County Attorney, Steve Snyder to accept the Deeds from the city of Lakewood; 2) the Chairman of the Board to execute a Commissioner's Deed conveying the property to the City of Lakewood with the Open Space reverter clause; 3) the County Attorney's Office to cause said deed(s) or other documents to be recorded in the office of the Clerk and Recorder of Jefferson County; 4) the Treasurer or his designee to make an electronic payment reimbursing the City of Lakewood using the city's allocation of Open Space Bond Funds and using specific payment delivery instructions to be provided by the Director of Accounting.

Commissioner Lawrence seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

The Resolution was adopted by majority vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
