Commissioner Holloway moved that the following Resolution be adopted:
BEFORE THE BOARD OF COUNTY COMMISSIONERS
OF THE COUNTY OF JEFFERSON
STATE OF COLORADO
RESOLUTION NO. CC00-456
RE: A RESOLUTION SUBMITTING THE ISSUE OF AUTHORIZING AN INCREASE IN THE MILL LEVY FOR THE SUPPORT OF THE JEFFERSON COUNTY PUBLIC LIBRARY TO THE REGISTERED ELECTORS OF THE COUNTY AT THE ELECTION TO BE HELD ON NOVEMBER 7, 2000 AND RATIFYING ACTION PREVIOUSLY TAKEN AND APPERTAINING THERETO.
WHEREAS, the County of Jefferson (the "County") in the State of Colorado, is a county duly organized and existing under the Constitution (the "Constitution") and the laws of the State of Colorado; and
WHEREAS, the members of the Board of County Commissioners (the "Board") have been duly elected, chosen and qualified; and
WHEREAS, pursuant to Section 24-90-110(4), Colorado Revised Statutes, the Board of Trustees of the Jefferson County Public Library (the "Library") has requested that the Board submit to a vote of the registered electors of the County the issue of authorizing the County to increase the current mill levy for Library purposes; and
WHEREAS, Article X, Section 20 of the Constitution ("TABOR") requires voter approval for a mill levy above that for the prior year; and
WHEREAS, November 7, 2000 is one of the election dates at which tax questions may be submitted to the registered electors of the County pursuant to TABOR; and
WHEREAS, the County Clerk of the County (the "Clerk") is conducting a coordinated election on November 7, 2000 (the "Election"); and
WHEREAS, it is necessary to submit to the registered electors of the County, at the Election, the issue of authorizing the County to increase the current mill levy for Library purposes.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF JEFFERSON COUNTY, IN THE STATE OF COLORADO:

Section 1. All action heretofore taken (not inconsistent with the provisions of this resolution) by the County, directed towards the Election is ratified, approved and confirmed. Unless otherwise defined herein, all terms used herein shall have the meanings specified in the Uniform Election Code of 1992, Title 1, Articles 1 through 13, Colorado Revised Statutes (the "Code").
Section 2. Pursuant to the Code, Section 24-90-112(1)(b)(III), C.R.S., and all other applicable laws of the State of Colorado, the Board hereby determines to submit to the registered electors of the County the question set forth in section 3 hereof at the Election.
Section 3. The question in substantially the following form shall be submitted to the registered electors of the County at the Election:
SHALL JEFFERSON COUNTY LIBRARY TAXES INCREASE $8,568,985 ANNUALLY (ESTIMATED REVENUES IN THE YEAR 2001) AND BY WHATEVER ADDITIONAL AMOUNTS ARE RECEIVED THEREAFTER BY INCREASING THE MAXIMUM LIBRARY MILL LEVY TO 5 MILLS; SHALL THE COUNTY BE PERMITTED TO COLLECT, RETAIN AND EXPEND SUCH TAXES AND INCOME THEREON AS A VOTER-APPROVED REVENUE CHANGE AND PROPERTY TAX REVENUE CHANGE UNDER ARTICLE X, SECTION 20 OF THE COLORADO CONSTITUTION AND TO EXCEED THE 5.5% PROPERTY TAX REVENUE GROWTH LIMITATION CONTAINED IN SECTION 29-1-301, COLORADO REVISED STATUTES AND ANY OTHER REVENUE LIMITATION CONTAINED IN THE LAWS OF THE STATE?
Section 4. The Clerk is hereby appointed as the designated election official for purposes of performing acts required or permitted by law in connection with the Election. The Clerk is authorized to take all action necessary to carry out this resolution.
Section 5. The officers and employees of the County are hereby authorized and directed to take all action necessary or appropriate to effectuate the provisions of this resolution.
Section 6. All orders, bylaws and resolutions, or parts thereof, in conflict with this resolution, are hereby repealed.
Section 7. If any section, paragraph, clause or provision of this resolution shall for any reason be held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph, clause or provision shall not affect any of the remaining provisions of this resolution.

The Resolution was adopted by majority vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
