Commissioner Holloway moved that the following Resolution be adopted:

RESOLUTION NO. CC00-484

Purpose: Rezoning to allow single-family detached residential uses (up to 56 lots)
Approximate Area: 7.25 Acres
WHEREAS, Ralph Jacobson filed an application with the Planning and Zoning Department of Jefferson County to rezone the herein described property in Jefferson County from Planned Development Zone District to Planned Development Amended Zone District; and
WHEREAS, a public hearing was held by the Jefferson County Planning Commission on July 26, 2000, at which time the Planning Commission, by formal resolution, recommended denial of the subject rezoning application; and
WHEREAS, after notice as provided by law, a public hearing was held by this Board on August 8, 2000, which hearing was continued for additional evidence and consideration to September 29, 2000, and for decision only to September 5, 2000; and
WHEREAS, based on the study of the Comprehensive Plan, comments of the Jefferson County Planning Commission, comments of the Jefferson County Planning and Zoning Department, comments of public officials and agencies, and testimony and written comments from all interested parties, this Board finds as follows:

1. That proper posting, publication and public notice were provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners of Jefferson County.
2. That the hearings before the Planning Commission and the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at those hearings.
3. That the applicant has demonstrated that a commercial development would not be viable on this site.
4. That the proposal is in substantial conformance with the South Jefferson County Community Plan because it meets applicable Plan recommendations including those relating to Housing, Infill, Services, Design and Environmental. The proposal meets the special housing criteria and, therefore, qualifies for a density of 4 to 10 dwelling units per acre. The proposal will provide needed affordable housing in South Jefferson County.
5. That the proposed use is compatible with existing and allowable residential uses in the surrounding area. The development will provide a transition between multi-family residences to the north and single-family residences to the south on slightly larger lots. South Simms Street and associated landscaping will provide a buffer between the development and larger lot single-family residences to the east. To the west of the development are single-family residences on similarly sized lots.
6. The subject property is served by the West Metro Fire Protection District and Lakehurst Water and Sanitation District.
7. No known commercial mineral deposits exist upon the subject property.
8. That for the above stated reasons, the applied for rezoning is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the residents of Jefferson County.
9. That each of the factors set forth above is adequate independently to support this resolution.

NOW, THEREFORE, BE IT RESOLVED that Rezoning Application Case No. 99015296RZP1 to amend Jefferson County Zoning Map Nos. 33, 34, 56 & 57 to rezone the Planned Development Zone District to Planned Development Amended Zone District for the following described unincorporated area of Jefferson County, be and hereby is APPROVED.
