Commissioner Holloway moved that the following Resolution be adopted:

RESOLUTION NO. CC00-494

CASE NO. 00015196COP1 and 00015196IAP1

APPLICANT: JEFFERSON COUNTY AND

LOCATION: LOT 1, BLOCK 9, CHATFIELD GREEN

PURPOSE: TO AMEND THE CHATFIELD ACTIVITY CENTER COMPREHENSIVE DEVELOPMENT PLAN

WHEREAS, The Board of County Commissioners adopted the Chatfield Activity Center Comprehensive Development Plan effective February 26, 1991; and

WHEREAS, in March 1991, the Board of County Commissioners and the City Council for the City of Littleton entered into an Intergovernmental Agreement for the Chatfield Activity Center; and

WHEREAS, the Intergovernmental Agreement requires favorable action by both parties to amend the Comprehensive Development Plan; and

WHEREAS, a proposal has been made to amend certain provisions of the Comprehensive Development Plan containing development standards applicable to Lot 1, Block 9 of Chatfield Green Subdivision Filing No. 2; and

WHEREAS, after notice as provided by law, a public hearing was held by this Board on September 12, 2000; and

WHEREAS, based on the study of the Intergovernmental Agreement and the Comprehensive Development Plan, recommendations of the Jefferson County Planning and Zoning Department, comments of public officials and agencies, and testimony and written comments from all interested parties, this Board finds as follows:

1. That proper posting, publication and public notice was provided as required by law for the hearing before the Board of County Commissioners of Jefferson County.

2. That all interested parties were given an opportunity to be heard at the hearing.

3. That the proposed amendments are limited to Lot 1, Block 9 of Chatfield Green Subdivision Filing No. 2, and consist of reductions in building setbacks, elimination of a landscape buffer, and changes in the definitions of building separation and building setback.

4. That Chatfield Green was previously annexed into the City of Littleton and that the City of Littleton has adopted an ordinance approving the proposed amendments.

5. That the proposed amendments will facilitate development of the Chatfield Activity Center in accordance with the intent of the Intergovernmental Agreement, and the proposed amendments are in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the residents of Jefferson County.

NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners hereby approves the amendments to the Chatfield Activity Center Comprehensive Development Plan as set forth in Exhibit A, attached hereto.

Commissioner Sheehan seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

The Resolution was adopted by majority vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
