Commissioner Lawrence moved that the following Resolution be adopted:

BEFORE THE BOARD OF COUNTY COMMISSIONERS

OF THE COUNTY OF JEFFERSON

STATE OF COLORADO

RESOLUTION NO. CC00-524

RE: COMMUNITY RESOURCES - OPEN SPACE - PC/WHEAT RIDGE/DAVIS OS00-12

Resolved, that the Board of County Commissioners hereby approves Open Space Advisory Committee Resolution Numbers 45-00 and authorizes the expenditure of $550,000, plus the cost of appraisals, surveys, environmental site assessments, and transaction costs, less 25% of all such costs which the City of Wheat Ridge will pay, up to $146,000. The property is one of the City of Wheat Ridge's priority projects and would be suitable for park purposes in accordance with the Board of County Commissioners' Resolution CC99-488 and the City of Wheat Ridge's Resolution Number 26-2000.

Authorization for: 1) The property to be directly transferred to the City of Wheat Ridge with an Open Space executory limitation in the County, and the Chairman of the Board to accept such executory limitation, and said deed(s) or documents to be recorded in the office of the Clerk and Recorder of Jefferson County; 2) the Director of Open Space, or his designee, Joy A. Lucisano, Manager of Acquisitions, to sign the closing documents; 3) the costs of the acquisition to be funded 25% from other city of Wheat Ridge funds up to $146,000, and the remainder from the City of Wheat Ridge's allocation of Open Space Bond Funds and 4) the Treasurer or his designee to make an electronic payment for the purchase price and transaction costs, using specific payment delivery instructions to be provided by the Director of Accounting.

Commissioner Sheehan seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

The Resolution was adopted by majority vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
