Purpose: Rezoning to amend existing Official Development Plan to increase gross leaseable area

Approximate Area: 12.68 Acres

WHEREAS, General Growth Properties, Inc. for Southwest Plaza LLC filed an application with the Planning and Zoning Department of Jefferson County to rezone the herein described property in Jefferson County from Planned Development and Agricultural-Two Zone District to Planned Development Amended Zone District; and

WHEREAS, a public hearing was held by the Jefferson County Planning Commission on October 11, 2000, which hearing was continued for additional testimony and deliberation to October 18, 2000, at which time the Planning Commission did, by formal resolution, recommend approval of the subject rezoning application with conditions; and


WHEREAS, after notice as provided by law, a public hearing was held by this Board on October 24, 2000; and

WHEREAS, based on the study of the Comprehensive Plan, recommendations of the Jefferson County Planning Commission, recommendations of the Jefferson County CC00-567

Planning and Zoning Department, comments of public officials and agencies, and testimony and written comments from all interested parties, this Board finds as follows:

1. That proper posting, publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners of Jefferson County.

2. That the hearings before the Planning Commission and the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at those hearings.

  1. As conditioned below, the proposal is in substantial conformance with the South Jefferson Community Plan because:
  2. a. The requested intensity of development can be accommodated in the existing activity center and by available services.

    b. The Community Plan supports retaining the viability of a primary regional retail center, with greater attention to overall design and improved landscaping.

    c. The Community Plan supports the viability of the Southwest Plaza Activity Center, improvement of the County's tax base, expansion of community services, and promotion of the retail hub offered by this portion of the activity center.

  3. As conditioned below, the proposed land use is compatible with existing and allowable land uses in the surrounding area in all directions because:
    1. The proposed uses are consistent with the current uses on the property and are compatible with uses in the surrounding area. The proposal will facilitate the retention and improvement of facilities on this site. The proposed facility will generate more traffic impact, but surrounding streets are able to accommodate that impact and the applicant has agreed to improve access points to the property. With the architectural elements the applicant has committed to, the design of the new facility will be a significant improvement over the existing facility.

    1. The applicant has agreed to make additional improvements to the ingress and the egress from the area.

5. That for the above stated reasons, the applied for rezoning is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the residents of Jefferson County.

6. That each of the factors set forth above is adequate independently to support this resolution.

7. The subject property is served by the West Metro Fire Protection District.

8. No known commercial mineral deposits exist on the subject property.

NOW, THEREFORE, BE IT RESOLVED that Rezoning Application Case No. 00015278RZP1 to amend Jefferson County Zoning Map No. 35 to rezone the Planned Development and Agricultural-Two Zone District to Planned Development Amended Zone District for the following described unincorporated area of Jefferson County, be and hereby is APPROVED, subject to the following conditions:

a. Building plans provided by the applicant must be incorporated into the written restrictions so that the obligation to build in accordance with those plans is clear, and so that the buildings contain the architectural details shown. The architectural details must also be included in the signage for the building and the free-standing identification sign along West Bowles Avenue.

b. Correction to the Official Development Plan ("ODP") as shown on the red-marked print dated October 18, 2000 including items added at the Planning Commission hearing.

c. Correction to the Written Restrictions as shown on the red-marked print dated October 18, 2000 including items added at the Planning Commission hearing.

d. Correction of ownership information (Assessor's Office memorandum dated 8/2/00).

    1. The applicant has agreed to implement improvements to three ingress/egress areas. One area is within the ODP and two are outside of the ODP. The two outside the ODP are the access to the mall ring road at Bowles, which is referred to as the second access to the east of Cross, and the access at Alamo and Cross Drive. The improvements
