RESOLUTION NO. CC00-580

Purpose: Rezoning to allow mini-storage facility, caretakers unit and outdoor storage

Approximate Area: 6.23 Acres

WHEREAS, Dale Bryant filed an application with the Planning and Zoning Department of Jefferson County to rezone the herein described property in Jefferson County from Residential-Two Zone District to Planned Development Zone District; and

WHEREAS, a public hearing was held by the Jefferson County Planning Commission on November 1, 2000, at which time the Planning Commission, by formal resolution, recommended approval of the subject rezoning application with conditions; and

WHEREAS, after notice as provided by law, a public hearing was held by this Board on November 14, 2000; and

WHEREAS, based on the study of the Comprehensive Plan, recommendations of the Jefferson County Planning Commission, recommendations of the Jefferson County Planning and Zoning Department, comments of public officials and agencies, and testimony and written comments from all interested parties, this Board finds as follows:

1. That proper posting, publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners of Jefferson County.

2. That the hearings before the Planning Commission and the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at those hearings.

  1. While the proposal is in not in substantial conformance with the General Land Use Plan because the Plan recommends multi-family residential development for the subject land, circumstances in the vicinity of the subject land have changed such that the recommendation of the Plan for multi-family housing is no longer applicable. The area surrounding the subject land has become more commercial in nature and the need for multifamily housing has been satisfied by the construction of multifamily homes nearby. Moreover, Isabell street is a cul-de-sac and would not function properly if multi-family homes were built on the subject land. Moreover, the proposal does satisfy the individual issues addressed in the Plan, including water quality and quantity, wildlife, hazards, sensory resources, transportation, public water and sewer, fire protection service, and community form.
  2. As conditioned below, the proposed land use is compatible with existing and allowed residential and commercial land uses in the surrounding area. The proposed site is an infill site that abuts Interstate 70, Camp George West, Denver West Business Park, and some single family homes. Restrictions on building layout and design will help buffer the use from existing homes.
  3. The subject property is served by the Pleasant View Fire Protection District, the Consolidated Mutual Water District and the Pleasant View Sanitation District.

6. No known commercial mineral deposits exist on the subject property.

7. That for the above stated reasons, the applied for rezoning is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the residents of Jefferson County.

8. That each of the factors set forth above is adequate independently to support this resolution.

NOW, THEREFORE, BE IT RESOLVED that Rezoning Application Case No. 00015015RZP1 to amend Jefferson County Zoning Map No. 52 to rezone the Residential-Two Zone District to Planned Development Zone District for the following described unincorporated area of Jefferson County, be and hereby is APPROVED, subject to the following conditions.

  1. Prior to issuance of a building permit, the applicant must satisfy the requirements set forth by CDOT, including improvements to the culvert under I-70 and proof that the applicant obtained the property after the environmental assessment was conducted.
