Commissioner Lawrence moved that the following Resolution be adopted:

BEFORE THE BOARD OF COUNTY COMMISSIONERS

OF THE COUNTY OF JEFFERSON

STATE OF COLORADO

RESOLUTION NO. CC00-598

Resolved, that the Board of County Commissioners hereby approves the Open Space Advisory Committee Resolution Number 56-00 and execute a Indefinite Term Lease between The Burlington Northern and Santa Fe Railway Company, a Delaware Corporation (BNSF), and Jefferson County for portions of the BNSF ownership along the Church Ditch adjacent to Highway 58 in Golden.

Authorization for: 1) the Chairman of the Board to execute the Indefinite Term Lease Agreement; 2) the County Attorney’s Office to cause said deed or documents to be recorded in the office of the Clerk and Recorder of Jefferson County; 3) the Treasurer or his designee to make an electronic payment for the annual lease amount of $500, using specific payment delivery instructions to be provided by the Director of Accounting.

Commissioner Holloway seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

The Resolution was adopted by unanimous vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
