Purpose: Rezoning to allow single family residential uses

Approximate Area: 5.17 Acres

WHEREAS, Colorado Land Company, LLC filed an application with the Planning and Zoning Department of Jefferson County to rezone the herein described property in Jefferson County from Planned Development Zone District to Planned Development Amended Zone District; and

WHEREAS, a public hearing was held by the Jefferson County Planning Commission on November 29, 2000, at which time the Planning Commission did, by formal resolution, recommend approval of the subject rezoning application with conditions; and

WHEREAS, after notice as provided by law, a public hearing was held by this Board on December 12, 2000; and

WHEREAS, based on the study of the Comprehensive Plan, comments of the Jefferson County Planning Commission, comments of the Jefferson County Planning and Zoning Department, comments of public officials and agencies, and testimony and written comments from all interested parties, this Board finds as follows:

1. That proper posting, publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners of Jefferson County.

2. That the hearings before the Planning Commission and the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at those hearings.
  1. As conditioned below, the proposal is in substantial conformance with the General Land Use Plan because the residential density suggested by the proposal is within the range recommended by the General Land Use Plan, community design encourages transitional housing for existing or new area residents, and the proposed single family detached product would be compatible with existing housing in the immediate area.
  2. The proposed land use is compatible with existing and allowable land uses in the surrounding area in all directions because West 32nd Avenue is designed to accommodate the increased traffic with the improvements that will occur during platting, the residential product will be consistent with higher density residential development products north of West 32nd Avenue, and it allows for a transition in housing options for residents south of West 32nd Avenue.

5. That for the above stated reasons, the applied for rezoning is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the residents of Jefferson County.

 

6. That each of the factors set forth above is adequate independently to support this resolution.

7. The subject property is served by the West Metro Fire Protection District.

8. No known commercial mineral deposits exist on the subject property.

NOW, THEREFORE, BE IT RESOLVED that Rezoning Application Case No. 00015339RZP1 to amend Jefferson County Zoning Map No. 51 to rezone the Planned Development Zone District to Planned Development Amended Zone District for the following described unincorporated area of Jefferson County, be and hereby is APPROVED, subject to the following conditions:
