Commissioner Lawrence moved that the following Resolution be adopted:

RESOLUTION NO. CC00-623

Purpose: Special Use to allow a camp, picnic ground, lodge and other similar uses for supervised youth
Approximate Area: 13.35 Acres
WHEREAS, Dorothy Jean Chamberlin filed a Special Use application to allow a camp, picnic ground, lodge and other similar uses for supervised youth; and
WHEREAS, a public hearing was held by the Jefferson County Planning Commission on August 23, 2000, which hearing was continued to September 27, 2000, and to November 29, 2000, at which time the Planning Commission, by formal resolution, recommended approval of the subject Special Use application with conditions; and
WHEREAS, after notice as provided by law, a public hearing was held by this Board on December 12, 2000, which hearing was continued for decision only to December 19, 2000; and
WHEREAS, based on the study of the Comprehensive Plan, recommendations of the Jefferson County Planning Commission, recommendations of the Jefferson County Planning and Zoning Department, comments of public officials and agencies, and testimony and written comments from all interested parties, this Board finds as follows:

1. That proper posting, publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners of Jefferson County.
2. That the hearings before the Planning Commission and the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at those hearings.
3. As conditioned below, the proposal is in substantial conformance with the Special Use Criteria of the Zoning Resolution because the proposed use as an outdoor recreational area for a limited number of people is consistent with the open space character of the immediate area.
4. That the proposed land use is compatible with existing and allowable land uses in the surrounding area in all directions because the proposed use of the site as an outdoor recreational facility would leave the site in a generally undisturbed condition. The special use area is a small portion of a larger site that buffers adjoining properties. There are City and County of Denver and Jefferson County open space tracts in the immediate area, and another limited use recreational property nearby on City and County of Denver property to the west.
5. That for the above stated reasons, the applied for Special Use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the residents of Jefferson County.
6. That each of the factors set forth above is adequate independently to support this resolution.
7. That no known commercial mineral deposits exist upon the subject property.
8. The subject property is served by the North Fork Fire Protection District.
NOW, THEREFORE, BE IT RESOLVED that the Special Use application, Case No. 99015393SUP1, to allow a camp, picnic ground, lodge and other similar uses for supervised youth for the following described unincorporated area of Jefferson County be and hereby is APPROVED subject to the following conditions:
a. Correction of the red-marked Special Use Graphic dated August 23, 2000.

b. Modification of the draft written restrictions, dated November 29, 2000, to include the adjustments noted in the additional clarification of the special use provided and to accommodate the following adjustments:
1. Restricting the existing residence to a caretaker's residence.
2. Stipulate that there are no open outdoor fires allowed on the property. The only fires allowed will be in the one (1) outdoor fireplace as approved by the North Fork Fire Protection District. The location shall be shown on the Special Use graphic.
c. Obtain the necessary County approvals for the individual sewage disposal system and water service identified in the memoranda of December 23, 1999 and August 1, 2000, by the Jefferson County Department of Health and Environment within 120 days after approval of the Special Use application.
d. Complete the private roadway alterations to meet the North Fork Fire Protection District recommendations and those of the Planning Engineering Department within 120 days after approval of the Special Use application.
