Commissioner Holloway moved that the following Resolution be adopted:

Applicant: Randall and Nina Dugdale

Location: 6450 County Highway 73

(Section 22, Township 5 South, Range 71 West)

Zoning: Mountain Residential-One

Purpose: Special Use to allow a personal care boarding home for the elderly

Approximate Area: 1.3 Acres

WHEREAS, Randall and Nina Dugdale filed a Special Use application to allow an increase in residents in a personal care boarding home for the elderly; and

WHEREAS, a public hearing was held by the Jefferson County Planning Commission on December 20, 2000, which hearing was continued to January 3, 2001, at which time the Planning Commission, by formal resolution, recommended approval of the subject Special Use application with a condition; and

WHEREAS, after notice as provided by law, a public hearing was held by this Board on January 23, 2001; and

WHEREAS, based on the study of the Comprehensive Plan, recommendations of the Jefferson County Planning Commission, recommendations of the Jefferson County Planning and Zoning Department, comments of public officials and agencies, and testimony and written comments from all interested parties, this Board finds as follows:

. That proper posting, publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners of Jefferson County.

2. That the hearings before the Planning Commission and the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at those hearings.

  1. As conditioned below, the proposal is in substantial conformance with the Special Use Criteria of the Zoning Resolution. The proposed increase meets all applicable Special Use Criteria, including Traffic Impacts, Fire Hazards, Visual and Aesthetic Impacts, Solar Access, Noise, Geologic Hazards, Drainage, Erosion, and Flood Hazards, and Community Character, and Adequate Water and Sewer.

4. That, as conditioned below, the proposed land use is compatible with existing and allowable land uses in the surrounding area. The personal care boarding home is already in existence; the Special Use is to increase the number of residents. A personal care boarding home is considered residential in character and results in impacts similar to surrounding residential uses.

5. That for the above stated reasons, the applied for Special Use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the residents of Jefferson County.

6. That each of the factors set forth above is adequate independently to support this resolution.

7. That no known commercial mineral deposits exist upon the subject property.

8. The subject property is served by the Evergreen Fire Protection District.

NOW, THEREFORE, BE IT RESOLVED that the Special Use application, Case No. 00015153SUP1, to allow a personal care boarding home facility for the elderly for the following described unincorporated area of Jefferson County be and hereby is APPROVED subject to the following conditions:

    1. Revisions to the Special Use Written Restrictions and Graphic in accordance with the red-marked print dated December 27, 2000 prior to preparation of a mylar for recording.

    3. This Special Use approval is for a maximum of 10 residents, plus necessary staff. After the Special Use is recorded, if the Jefferson County Department of Health and Environment (JCDHE) reviews the water usage at the facility and determines that adequate water and septic facilities exist to support a maximum of 12 residents, plus necessary staff, the applicant shall provide to the Planning and Zoning Department written documentation of the JCDHE determination. At that time, the maximum permissible number of residents in the facility will be increased to 12, plus necessary staff.
