Commissioner Stone moved that the following Resolution be adopted:
BEFORE THE BOARD OF COUNTY COMMISSIONERS
OF THE COUNTY OF JEFFERSON
Authorize obtaining a survey and title commitment/policy for the subject property.
WHEREAS, Lynn Wodell, Manager of Acquisitions, presented to the Jefferson County Open Space Advisory Committee an Open Space Proposal, number OS89-117, on December 7, 1989; and
WHEREAS, on January 18, 1990, during a regularly scheduled meeting, the Jefferson County Open Space Advisory Committee, by a unanimous vote of nine (9), on June 19, 1990, by Resolution No. 40-90 recommended that the Board of County Commissioners authorize the Open Space Department to obtain a survey and title commitment/policy for the referenced property or portions thereof to be considered subject to certain terms and conditions; and
WHEREAS, a majority of the Jefferson County Open Space Advisory Committee present personally inspected the proposed lands on a field trip, independently, and believe this to be a high priority acquisition; and
WHEREAS, the Board of County Commissioners has considered the above-referenced Open Space Advisory Committee recommendation and concurs with the following Open Space Advisory Committee findings:
1.That the Open Space Proposal No. OS89-117 falls within the criteria, intent and purpose set forth in the current 1989 Jefferson County Open Space Master Plan;
2.That the Open Space Proposal No. OS89-117 is within the general purpose and intent of the Board of County Commissioners Jefferson County Open Space Resolution, dated the 7th day of November, l972 and amended September 19, 1980;

3.That the Open Space Advisory Committee approved Resolution No. l0-90 on February l, l990, recommending that the reimbursement to Golden of $274,800 from its attributable share; contingent upon certain terms and conditions, including, but not limited to the following:
That the 1.28 acres or portions thereof be conveyed by the City of Golden to Jefferson County and back to the City by Commissioner's Deed containing the Open Space reverter as follows:
"If the City, its successors and assigns shall use the property for any purpose other than public, open space, park and recreational purposes, the property shall revert to the County and the deed shall be null and void;"
4.That the reimbursement was contingent on Golden providing a title policy and survey to Jefferson County;
5.That the City Council of Golden passed Resolution No. 362 on April 26, 1990, requesting that the Open Space staff obtain the title policy and survey on their behalf to complete this reimbursement process.
NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of the County of Jefferson, State of Colorado, hereby and herewith authorizes the Jefferson County Open Space Department to obtain a title commitment/policy and survey for the referenced property (1.28 acres).
BE IT FURTHER RESOLVED that the cost of the title policy and survey shall be 100% from Golden's attributable share of the Open Space fund.
Commissioner Clement seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

The Resolution was adopted by unanimous vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
