Commissioner Clement moved that the following Resolution be adopted:

BEFORE THE BOARD OF COUNTY COMMISSIONERS

OF THE COUNTY OF JEFFERSON

STATE OF COLORADO

RESOLUTION NO. CC91-4

RE: LAND USE REGULATIONS: GUIDELINES FOR EXPENDITURES OF MONIES PAID IN LIEU OF DEDICATION OF LAND FOR PARKS AND SCHOOLS

WHEREAS, the Board of County Commissioners has adopted Resolution No. CC80-245 regarding the land use regulations; guidelines for expenditures of monies paid in lieu of dedication of land for park and schools; and

WHEREAS, pursuant to that procedure, the Jefferson County School District No. R-1 has submitted a Resolution, Request and Certification pursuant to the procedure established by the Board of County Commissioners; and

WHEREAS, said Resolution, Request and Certification is attached hereto and incorporated herein by reference as "Exhibit 1"; and

WHEREAS, said Certification has been signed on November 1, 1990, by Kirk P. Brady, President, Board of Education for JEFFERSON County School District No. R-1; and

WHEREAS, said Request and Certification has been reviewed and approved by the Director of Administrative Services; and

WHEREAS, the Jefferson County Treasurer has on deposit the amount referenced by "Exhibit 1" which list the account number and amount on deposit.

NOW, THEREFORE, BE IT RESOLVED that the Resolution, Request and Certification attached hereto as "Exhibit 1" is approved by the Board of County Commissioners.

BE IT FURTHER RESOLVED that the Jefferson County Treasurer is hereby authorized to pay $10,546.40, plus any accrued interest therein as of the date of this Resolution, to the Jefferson County School District No. R-1 from the funds contained in the Subdivision-School Accounts identified in "Exhibit 1".

BE IT FURTHER RESOLVED that the funds shall be used in the School Attendance Areas as set forth in the Requests and Certifications set forth in "Exhibit 1" and in no event shall the

subject funds be used at a location or in a manner other than as authorized by Part I, Section 7.5.2.2 of the Jefferson County Land Development Regulation.

Commissioner Ferdinandsen seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

Commissioner Marjorie E. Clement AYE

Commissioner Rich Ferdinandsen AYE

Commissioner John P. Stone, Chairman AYE

The Resolution was adopted by unanimous vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
