Commissioner Stone moved that the following Resolution be adopted:

BEFORE THE BOARD OF COUNTY COMMISSIONERS

OF THE COUNTY OF JEFFERSON

STATE OF COLORADO

RESOLUTION NO. 91-007

RE: AUTHORIZATION OF CHAIRMAN TO SIGN MOTION TO RECONSIDER ANNEXATION BY LITTLETON OF LOT 19, BLOCK 6 OF THE HERRICK- DALE SUBDIVISION

WHEREAS, the Board of County Commissioners of Jefferson County ("the Board") has carefully reviewed the annexation by the City of Littleton of Lot 19, Block 6 of the Herrick-Dale Subdivision ("Lot 19"); and

WHEREAS, by Resolution CC 90-1093 submitted to the City Council of the City of Littleton and by staff appearance at the City Council hearing held on December 18, 1990, the Board has expressed its concerns to the City Council of the City of Littleton regarding the negative impacts upon orderly urban growth and upon the surrounding residents of unincorporated areas of such annexation; and

WHEREAS, on December 18, 1990 the City passed Ordinance No. 58, which became effective on December 28, 1990, and which annexed Lot 19 to the City of Littleton; and

WHEREAS, Section 31-12-116(2)(a)(II) C.R.S. requires the Board to file a Motion for Reconsideration with the City within ten days of the effective date of the Ordinance as a condition precedent to initiating judicial review of said annexation; and

WHEREAS, because the annexation of Lot 19 violates the Municipal Annexation Act of 1965, as amended, and because of the negative impact of the annexation on unincorporated Jefferson County, theBoard desires to submit a Motion for Reconsideration to enable it to obtain judicial review of said annexation.

NOW, THEREFORE, BE IT RESOLVED that the Chairman is authorized to sign a Motion for Reconsideration of the annexation of lot 19 stating the grounds upon which the annexation is opposed, including but not limited to those set forth in Resolution No. CC 90-1093.

NOW, THEREFORE, BE IT FURTHER RESOLVED that the County Attorney's Office is directed to file the Motion for Reconsideration within ten days of the effective date of Ordinance 58.

The Resolution was adopted by unanimous vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
