Commissioner Clement moved that the following Resolution be adopted:
BEFORE THE BOARD OF COUNTY COMMISSIONERS
OF THE COUNTY OF JEFFERSON
EDITION OF THE UNIFORM FIRE CODE
WHEREAS, pursuant to the provisions of Title 32, Article 1, Section 1002(1)(d), C.R.S., as amended, the Board of Directors has adopted by written resolution the 1988 Edition of the Uniform Fire Code (the "Elk Creek Fire Code"), and seeks to enforce the Elk Creek Fire Code within its boundaries; and
WHEREAS, the District's Resolution is attached hereto as Appendix A and incorporated herein by this reference; and
WHEREAS, the Board of Directors of the Elk Creek Fire Protection District have determined that the Elk Creek Code is necessary and will assist in the preservation of property and lives, promote the prevention of fire and damage within the District and is in the best interest of the District and Jefferson County; and
WHEREAS, this Board of County Commissioners of Jefferson County has fully considered the testimony and other evidence presented to it in this matter.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Jefferson, State of Colorado, that pursuant to the provisions of Title 32, Article 1, Section 1002(1)(d), C.R.S., as amended, the Elk Creek Fire Code as set forth in Appendix A hereto, shall be applicable within all unincorporated areas of the County which are also within the boundaries of the Elk Creek Fire Protection District, specifically contingent upon the following conditions:
1.That is shall be the sole and exclusive responsibility of the Elk Creek Fire Protection District to enforce the Elk Creek Fire Code.
2.That the approval of the Elk Creek Fire Code does not supersede, amend, waive or otherwise affect the provisions or the enforcement of the Jefferson County Building code or any other Jefferson County code, ordinance or regulation.
3.That the approval of the Elk Creek Fire Code does not extend to any subsequent alteration, modification, rescission, rrepeal or amendment, in whole or in part, of the Elk Creek Fire Code as set forth in Appendix A hereto.
Commissioner Ferdinandsen seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

The Resolution was adopted by unanimous vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
