Commissioner Clement moved that the following Resolution be adopted:

OF THE COUNTY OF JEFFERSON

Location: W. 76th Avenue, West of Quaker Street, Section 36, Township 2 South, Range 70 West
From: Agricultural-Two (A-2) Zone District
To: Suburban Residential-One (SR-1) Zone District
Purpose: To rezone 5 acres for 1 acre lots
Approximate Area: 4.98 Acres
WHEREAS, Donald Richard White and Marion J. White did file an application with the Planning Department of Jefferson County on or about July 12, 1990, to rezone the herein described property in Jefferson County from Agricultural-Two (A-2) Zone District to Suburban Residential-One (SR-1) Zone District; and
WHEREAS, a public hearing was held by the Jefferson County Planning Commission on January 2, 1991, at which time the Planning Commission did, by formal resolution, recommend approval of the subject rezoning application; and
WHEREAS, after notice as provided by law, a public hearing was held by this Board on January 15, 1991, at which time this matter was continued until January 22, 1991, for decision; and
WHEREAS, based on the evidence, testimony, exhibits, study of the Comprehensive Plan, recommendations of the Jefferson County Planning Commission, comments of the Jefferson County Planning Department, comments of public officials and agencies, and
comments from all interested parties, this Board finds as follows:

1.That proper posting, publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners of Jefferson County.
2.That the hearings before the Planning Commission and the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at those hearings.
3.That the proposal is in substantial conformance with the criteria of most major issue areas of the North Plains Community Plan component of the Jefferson County Comprehensive Plan in that the density is less than the four dwelling units per acre maximum recommended in the Plan. In the areas of potential non-conformance, such as traffic impact, access, right-of-way and street improvements and drainage, problems can be effectively addressed at the time of platting.
4.That the proposed land use is compatible with allowable land uses in the surrounding area in all directions in that several subdivisions with one acre lots are located within the vicinity.
5.That the proposed land use is compatible with existing land uses in the surrounding area in all directions for the reason set forth above.
6.That the subject property is located in the Ralston Valley Water and Sanitation District. The subject property will also be served by Arvada Fire Protection District.
7.That no known commercial mineral deposits exist upon the subject property.
8.That for the above stated reasons, the applied for rezoning is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Jefferson County.

NOW, THEREFORE, BE IT RESOLVED that Rezoning Application Case No. Z90-26 to amend Jefferson County Zoning Map No. 73 to include within the Suburban Residential-One (SR-1) Zone District and to exclude from Agricultural-Two (A-2) Zone District the following described unincorporated area of Jefferson County, be and hereby
is APPROVED.
Commissioner Ferdinandsen seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

The Resolution was adopted by unanimous vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
