Commissioner Ferdinandsen moved that the following Resolution be adopted:

BEFORE THE BOARD OF COUNTY COMMISSIONERS

OF THE COUNTY OF JEFFERSON

STATE OF COLORADO

RESOLUTION NO. CC91-54

Case No. ZP85-75Map Nos. 34 and 57

Applicant:Carlin B. Joslyn, Gerald F. Vanner, Carrie Thurlow, and Gerald C. Vanner

Location: Simms Street south of Belleview, Section 17, Township 5 South, Range 69 West

From: Planned Development (PD) Zone District

To: Agricultural-One (A-1) and Suburban Residential-One (SR-1) Zone Districts

Purpose: To repeal the Board of County Commissioners Resolution No. CC86-561 conditionally rezoning the property to Planned Development and rezoning the property to Agricultural-One (A-1) and Suburban Residential-One (SR-1) Zone Districts

Approximate Area: 14.906 Acres

WHEREAS, the Jefferson County Board of County Commissioners did pass a resolution on or about August 5, 1986 conditionally approving an application to rezone the herein described property in Jefferson County to Planned Development (PD) Zone District subject to the filing of the Official Development Plan; and

WHEREAS, said Official Development Plan has never been filed; and

WHEREAS, a public hearing was held by the Jefferson County Planning Commission on January 2, 1991, at which time the Planning Commission did, by formal resolution, recommend approval of the rezoning from Planned Development to Agricultural-One (A-1) and Suburban Residential-

one (SR-1) with the same boundary for the zone districts as set forth on the zoning maps in effect on August 5, 1986; and

WHEREAS, after notice as provided by law, a public hearing was held by this Board on January 15, 1991, at which time this matter was continued until January 22, 1991, for decision; and

WHEREAS, based on the evidence, testimony, exhibits, study of the Comprehensive Plan, recommendations of the Jefferson County Planning Commission, comments of the Jefferson County Planning Department, comments of public officials and agencies, and comments from all interested parties, this Board finds as follows:

1.That proper posting, publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners of Jefferson County.

2.That the hearings before the Planning Commission and the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at those hearings.

3.That the proposal is in substantial conformance with the criteria of most major issue areas of the South Jefferson County Community Plan component of the General Land Use Plan component of the Jefferson County Comprehensive Plan. The density in the A-1 zone district and the SR-1 zone district is within the range of density recommended in the Plan.

4.That the proposed low density residential land use is compatible with allowable land uses in the surrounding area in all directions.

5.That the proposed low density residential land use is compatible with existing land uses in the surrounding area in all directions.

6.That the subject property is located in the Willowbrook Water and Sanitation District. The subject property will also be served by Bancroft Fire Protection District.

7.That no known commercial mineral deposits exist upon the subject property.

8.That for the above stated reasons, the applied for rezoning and revocation of the original rezoning is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Jefferson County.

NOW, THEREFORE, BE IT RESOLVED that Rezoning Application Case No. Z85-75 to amend Jefferson County Zoning Map Nos. 34 and 57 to include within the Agricultural-One (A-1) and Suburban Residential-One (SR-1) Zone District in accordance with the boundary set forth on the zoning map in effect on August 5, 1986 and to exclude from Planned Development (PD) Zone District the following described unincorporated area of Jefferson County, be and hereby is APPROVED.

Commissioner Clement seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

Commissioner John P. Stone, Chairman AYE

The Resolution was adopted by unanimous vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
