@@Commissioner Stone moved that the following Resolution be adopted:

BEFORE THE BOARD OF COUNTY COMMISSIONERS

OF THE COUNTY OF JEFFERSON

STATE OF COLORADO

RESOLUTION NO. CC92-287

Case No. SU91-9 Maps Nos. 15 and 35

Applicant:FAITH COMMUNITY CHURCH

Location: 6228 South Carr Court

Section 22, Township 5 South,

Range 69 West

Zone District:Suburban Residential-Five (SR-5) Zone District

Purpose: Special Use to allow expansion of existing church facility

Approximate Area:4.7 acres

WHEREAS, Faith Community Church did file an application with the Planning Department of Jefferson County on or about December 5, 1991, for authorization of a special use permit on the herein-described property in Jefferson County which is located in the Suburban Residential-Five (SR-5) Zone District; and

WHEREAS, a public hearing was held by the Jefferson County Planning Commission on February 19, 1992, at which time the Planning Commission did, by formal resolution, recommend approval of the subject special use application; and

WHEREAS, after notice as provided by law, a public hearing was scheduled for March 3, 1992, which was continued to March 17, 1992, by Resolution CC92-156; and

WHEREAS, after notice as provided by law, a public hearing was held by this Board on March 17, 1992, at which time this matter was continued until March 24, 1992, for decision; and

WHEREAS, based on the evidence, testimony, exhibits, study of the Comprehensive Plan, recommendations of the Jefferson County Planning Commission, comments of the Jefferson County Planning Department, comments of public officials and agencies, and comments from all interested parties, this Board finds as follows:

1.That proper posting, publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners.

2.That the hearings before the Planning Commission and the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at those hearings.

3.That the proposed special use, as conditioned below, is in conformance with the recommendation of the South Jefferson County Community Plan component of the Jefferson County Comprehensive Plan in that the Plan permits churches within an Infill parcel such as the subject property as long as certain impacts are minimized. The Landscape Plan is critical for this proposal to be compatible with the surrounding area.

4.That the proposed special use, as conditioned below, is compatible with allowable land uses in the surrounding area.

5.That the proposed special use, as conditioned below, is compatible with existing land uses in the surrounding area.

6.That the proposed special use, as conditioned below, substantially complies with the criteria for review of special use applications as set forth in the Jefferson County Zoning Resolution, Section (1)(G)(2), and in the areas of potential negative impacts, such as visual and aesthetic impact and community character those impacts have been effectively mitigated by the conditions set forth below.

7.That the subject property is located within the boundaries of the Southwest Metropolitan Water and Sanitation District and the Lakewood/Bancroft Combined Fire Authority.

8.That no known commercial mineral deposits exist upon the subject property.

9. That for the above-stated reasons, the applied for special use, as conditioned below, is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Jefferson County.

NOW, THEREFORE, BE IT RESOLVED that Special Use Application No. SU91-9, located within the Suburban Residential-Five (SR-5) Zone District for the following described unincorporated area of Jefferson County be and hereby is APPROVED, subject to the following conditions:

1.All revisions shall be made to the landscape plan as set forth on the red-marked print dated January 13, 1992. The revisions include but are not limited to: (a) providing additional trees along Wadsworth Boulevard at a minimum standard of one tree per 40 linear feet; (b) providing additional trees along the north, west and south property lines increasing the parking lot buffer to a minimum of one tree per 40 linear feet; (c) the detention pond and associated landscaping be shown; (d) the proposed groundcovers be specified; and (e) other minor landscape additions as shown on the plan.

2.The site sign/tower be eliminated from this proposal.

3.All revisions shall be made to the landscape plan and the site plan as set forth on the red-marked print dated January 13, 1992, on file in the Planning Department.

4.The parking spaces required shall be 207 at a minimum. The number of parking spaces may be expanded to 250 parking spaces on condition that any expansion above the 207 parking space level shall require installation of all landscaping as set forth on the landscape plan on file in the Planning Department. The landscaping for the 207 parking spaces and the perimeter landscaping for the entire parking area including the space reserved for the increase in parking (207 to 250 spaces) shall be installed or a performance guarantee provided to the County prior to the issuance of a building permit. The remaining landscaping for the additional parking shall be completed prior to the completion and use of the expanded parking area.

Commissioner Clement seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

The Resolution was adopted by majority vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
