BEFORE THE BOARD OF COUNTY COMMISSIONERS
OF THE COUNTY OF JEFFERSON
Case No. Z92-9 Map No. 52
Applicant: GARY AND BARBARA HOUGHTELING
Location: 12450 West 10th Avenue
Section 5, Township 4 South, Range 69 West
From: Residential-One (R-1) and Residential-Two (R-2) Zone Districts
To: Residential-One (R-1) Zone District
Purpose: To allow single family residential use
Approximate Area:2.49 acres
WHEREAS, Gary and Barbara Houghteling did file an application with the Planning Department of Jefferson County on or about February 17, 1992, to rezone the herein described property in Jefferson County from Residential-One (R-1) and Residential-Two (R-2) Zone Districts to Residential-One (R-1) Zone District; and
WHEREAS, a public hearing was held by the Jefferson County Planning Commission on April 8, 1992, at which time the Planning Commission did, by formal resolution, recommend approval of the subject rezoning application; and
WHEREAS, after notice as provided by law, a public hearing was held by this Board on April 21, 1992, at which time this matter was continued until April 28, 1992, for decision; and
WHEREAS, based on the evidence, testimony, exhibits, study of the Comprehensive Plan, recommendations of the Jefferson County Planning Commission, comments of the Jefferson County Planning Department, comments of public officials and agencies, and comments from all interested parties, this Board finds as follows:
1.That proper posting, publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners of Jefferson County.
2.That the hearings before the Planning Commission and the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at those hearings.
3.That the proposal is in substantial conformance with the criteria of all major issue areas of the General Land Use Plan component of the Jefferson County Comprehensive Plan. The development pattern maps recommend suburban residential ranging from two to seven dwelling units per acre. The proposed density of 3.2 dwelling units per acre falls within the recommended density.
4.That the proposed land use is compatible with allowable land uses in the surrounding area in all directions.
5.That the proposed land use is compatible with existing land uses in the surrounding area in all directions.
6.That the subject property is served by Consolidated Mutual Water Company for water services, by Daniels Sanitation District for sewer services, and also will be served by Lakewood Bancroft Combined Fire Authority.
7.That no known commercial mineral deposits exist upon the subject property.
8.That for the above stated reasons, the applied for rezoning is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizensof Jefferson County.
NOW, THEREFORE, BE IT RESOLVED that Rezoning Application Case No. Z92-9 to amend Jefferson County Zoning Map No. 52 to include within the Residential-One (R-1) Zone District and to exclude from the Residential-Two (R-2) Zone District the portion of the following described unincorporated area of Jefferson County thatis in the Residential-Two (R-2) Zone District, be and hereby is APPROVED:
THE NORTHWEST 1/4 OF THE NORTHEAST 1/4 OF THE NORTHEAST 1/4 OF THE SOUTHWEST 1/4 OF SECTION 5, TOWNSHIP 4 SOUTH, RANGE 69 WEST OF THE 6TH P.M., COUNTY OF JEFFERSON, STATE OF COLORADO
Commissioner Ferdinandsen seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

The Resolution was adopted by unanimous vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
