@@Commissioner Ferdinandsen moved that the following Resolution be adopted:

BEFORE THE BOARD OF COUNTY COMMISSIONERS

OF THE COUNTY OF JEFFERSON

STATE OF COLORADO

RESOLUTION NO. CC92-400

RE:PUBLIC WORKS - OPEN SPACE - HIWAN RIDGE/NOBLE MEADOW/EVERGREEN (OS91-26)

Authorize subject property for appraisal, title commitment, survey, environmental hazard assessment and authorize negotiations for acquisition.

WHEREAS, Lynn Wodell, Manager of Acquisitions, presented to the Jefferson County Open Space Advisory Committee Open Space Proposal Number 91-26 on August 29, 1991; and

WHEREAS, the Jefferson County Open Space Advisory Committee, by a unanimous vote of seven (7), did, on October 17, 1991, recommend that the Board of County Commissioners authorize obtaining a title commitment, appraisal, survey, environmental hazard assessment and authorize negotiations for acquisition of the referenced property subject to the following terms and conditions:

1.That the 342.35 acres, more or less, or portions thereof, and only lands currently zoned open space, located on both sides of Squaw Pass Road and west of the proposed alignment of Highway 74 be considered for acquisition, as identified on the attached map;

2.That negotiations be entered into to acquire less than full fee simple ownership, if possible, to obtain those rights that are necessary for the protection of the wildlife and scenic values;

3.That negotiations be entered into to acquire rights of way for trail corridors;

4.That the cost of acquisition shall be l00% from Jefferson County's attributable share of the Open Space fund; and

WHEREAS, the Jefferson County Board of County Commissioners (the "Board") has considered the above referenced Open Space Advisory Committee recommendation and concurs with the following Open Space Advisory Committee findings:

1.That the Open Space Proposal No. OS91-26 falls within the criteria, intent and purpose set forth in the current 1989 Jefferson County Open space Master Plan.

2.That the Open Space Proposal No. OS91-26 is within the general purpose and intent of the Board of County Commissioners Jefferson County Open Space Resolution, dated the 7th day of November, 1972, and amended September 19, 1980.

3.That the proposed land is highly desirable open space that would help some of the park, open space, and recreational needs of the residents of Jefferson County.

4.That the location of the above-referenced property would be suitable for scenic and wildlife preservation and a scenic/wildlife linkage to Elk Meadow Park;

5.That the above-referenced property consists of approximately 342.35 acres, more or less, or portions thereof.

NOW, THEREFORE, BE IT RESOLVED that the Board hereby and herewith authorizes obtaining a title commitment, appraisal, survey, environmental hazard assessment and authorizes negotiations for the acquisition subject to the following terms and conditions:

1. That approximately 342 acres, located on both sides of Squaw Pass Road and west of the proposed alignment of Highway 74 be considered for acquisition, at the general location set forth in the proposal;

2. That negotiations be entered into to acquire fee simple ownership or such lesser interest as deemed economically prudent to obtain those rights that are necessary for theprotection of wildlife and scenic values;

3. That negotiations be entered into to acquire rights of way for trail corridors; and

4. That the cost of acquisition shall be 100% from Jefferson County's attributable share of the Open Spacefund.

BE IT FURTHER RESOLVED that although the County is interested in the possible acquisition of the property by negotiation, the County does not intend at this time to acquire the property by eminent domain.

Commissioner Stone seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

Commissioner John P. Stone AYE

Commissioner Marjorie E. Clement, Chairman AYE

The Resolution was adopted by unanimous vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
