@@Commissioner Stone moved that the following Resolution be adopted:
BEFORE THE BOARD OF COUNTY COMMISSIONERS
OF THE COUNTY OF JEFFERSON
Lots 21-57 and 66-168
WHEREAS, the Board of County Commissioners did, on August 14, 1989, accept Subdivider's Completion Bond No. P89-611 from the Southern American Insurance Company in the amount of $85,140.55 to cover public and landscaping improvements in the Stony Creek Filing No. 9 Subdivision; and
WHEREAS, the Board of County Commissioners did, on August 12, 1991, accept a Surety Rider to Subdivider's Completion Bond No. P89-611 from the Southern American Insurance Company in the same amount of $85,140.55 and extending the completion date of said Bond to August 31, 1992, with all other terms and conditions remaining unchanged; and
WHEREAS, the Jefferson County Highways and Transportation Department has indicated, by memo dated April 23, 1992, that said Bond guarantees public improvements for the remaining undeveloped portions of the improvements consisting of Block 1, Lots 21-57 and 66-168, that no certificates of compliance have been issued for these lots and that these lots remain under the original plat restriction.
NOW, THEREFORE, BE IT RESOLVED that Block 1, Lots 21-57 and 66-168 shall be placed under a plat restriction and no certificates of compliance shall be issued until sufficient guarantee is accepted by the Board of County Commissioners.
BE IT FURTHER RESOLVED that Subdivider's Completion Bond No. P89-611 from the Southern American Insurance Company, together with its Surety Rider, be returned by the Director of
Administrative Services to the developer, MDC/Wood, Inc., c/o Richmond Homes, c/o Jim Tyner, at 4600 South Ulster, Suite 400, Denver, CO 80237.
Commissioner Ferdinandsen seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

The Resolution was adopted by unanimous vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
