BEFORE THE BOARD OF COUNTY COMMISSIONERS
OF THE COUNTY OF JEFFERSON
Case No. Z92-2 Map No. 74
Applicant: RICKY HARR

Section 36, Township 2 South, Range 70 West
From: Agricultural-One (A-1) Zone District
To: Planned-Development (P-D) Zone District
Purpose: To allow single family residential uses and limited number of large animals
Approximate Area:5.59 acres
WHEREAS, Ricky Harr did file an application with the Planning Department of Jefferson County on or about January 15, 1992, to rezone the herein described property in Jefferson County from Agricultural-One (A-1) Zone District to Planned-Development (P-D) Zone District; and
WHEREAS, a public hearing was held by the Jefferson County Planning Commission on April 29, 1992, at which time the Planning Commission did, by formal resolution, recommend approval of the subject rezoning application; and
WHEREAS, after notice as provided by law, a public hearing was held by this Board on May 5, 1992, at which time this matter was continued until May 12, 1992, for decision; and
WHEREAS, based on the evidence, testimony, exhibits, study of the Comprehensive Plan, recommendations of the Jefferson County Planning Commission, comments of the Jefferson County Planning Department, comments of public officials and agencies, and comments from all interested parties, this Board finds as follows:
1.That proper posting, publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners of Jefferson County.
2.That the hearings before the Planning Commission and the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at those hearings.
3.That the proposal is in substantial conformance with the criteria of most major issue areas of the North Plains Community Plan component of the Jefferson County Comprehensive Plan. The Plan proposes residential development of up to four dwelling units per acre when public water and sanitation are provided but no densities are established in the Plan for situations such as this where public water is used on one parcel and well and individual septic are used on the other parcel.
4.That the proposed land use is compatible with existing and allowable land uses in the surrounding area in all directions. The homes in the area are approximately one acre in size. This proposal will establish a minimum lot size of two acres.
5.That the subject property will be served by Ralston Valley Water District for water service for one lot and by an individual well for the other lot, by individual septic system for sewer services for both lots, and by Arvada Fire Protection District for fire service.
6.That no known commercial mineral deposits exist upon the subject property.
7.That for the above stated reasons, the applied for rezoning is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizensof Jefferson County.
NOW, THEREFORE, BE IT RESOLVED that Rezoning Application Case No. Z92-2 to amend Jefferson County Zoning Map No. 74 to include within the Planned-Development (P-D) Zone District and exclude from the Agricultural-One (A-1) Zone District the following described unincorporated area of Jefferson County, be and herebyis APPROVED, subject to the filing of the Official Development Plan with the written restrictions and minor changes as set forth on the red-marked print dated April 29, 1992, which is on file in the Planning Department:
