@@Commissioner Ferdinandsen moved that the following Resolution be adopted:

BEFORE THE BOARD OF COUNTY COMMISSIONERS

OF THE COUNTY OF JEFFERSON

STATE OF COLORADO

RESOLUTION NO. CC92-466

RE: Performance guarantee for Expiring Completion Bond -

E21-3-89 (Bandimere) (Drainage)

WHEREAS, the Board of County Commissioners did, on June 27, 1990, accept a Subdividers Completion Bond No. CC71219-00 from Commercial Union Assurance Companies in the amount of $53,835.00 to cover drainage improvements necessary to serve Exemption Case No. E21-3-89; and

WHEREAS, the Board of County Commissioners did, on October 1, 1990 accept a Continuation Certificate to Subdividers Completion Bond No. CC71219-00 from the Commercial Union Assurance Companies in the amount of $53,835.00 extending the completion date of said Subdividers Completion Bond to December 11, 1990, with all other terms and conditions remaining unchanged; and

WHEREAS, the Board of County Commissioners did, on December 18, 1990, accept a Continuation Certificate to Subdividers Completion Bond No. CC71219-00 from the Commercial Union Assurance Companies in the amount of $53,835.00 extending the completion date of said Subdividers Completion Bond to June 19, 1991, with all other terms and conditions remaining unchanged; and

WHEREAS, the Board of County Commissioners did, on May 20, 1991, 1990, accept a Continuation Certificate to Subdividers Completion Bond No. CC71219-00 from the Commercial Union Assurance Companies iin the amount of $53,835.00 extending the completion date of said Subdividers Completion Bond to June 19, 1992, with all other terms and conditions remaining unchanged; and

WHEREAS, the Jefferson County Department of Highways and Transportation has indicated, by memo dated May 15, 1992, that a reduced amount of $2,832.50 would be necessary for the completion of public and landscaping improvements within said subdivision; and

WHEREAS, the Subdivider has submitted a Decrease Endorsement to said Subdividers Completion Bond No. CC71219-00 from theCommercial Union Insurance Company dated May 6, 1992, in the reduced amount of $2,832.50; and a Continuation Certificate to said bond, extending the completion date to June 19, 1993, in the amount of $2,832.50, with all other terms and conditions remaining the same; and

WHEREAS, the County Attorney's Office has reviewed said Decrease Endorsement and Continuation Certificate to Subdividers Completion Bond No. CC71219-00 and has approved the same as to form.

NOW, THEREFORE, BE IT RESOLVED that the Surety Rider to Subdividers Completion Bond No. CC71219-00 dated May 6, 1992, from the Commercial Union Insurance Company extending the completion date to June 19, 1993, with all other terms and conditions remaining the same, be and hereby is accepted.

BE IT FURTHER RESOLVED that said Decrease Endorsement and Continuation Certificate to Subdividers Completion Bond No. CC71219-00 from Commercial Union Insurance Company deposited for safekeeping, together with the original Subdividers Completion Bond, by the Director of Administrative Services.

Commissioner Stone seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

Commissioner Marjorie E. Clement, Chairman AYE

The Resolution was adopted by unanimous vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
