@@Commissioner Ferdinandsen moved that the following Resolution be adopted:

BEFORE THE BOARD OF COUNTY COMMISSIONERS

OF THE COUNTY OF JEFFERSON

STATE OF COLORADO

RESOLUTION NO. CC92-684

RE: Performance guarantee for Ken Caryl Ranch, The Valley,

Filing No. 12, Phase 2 (Lots 1-12) - Public Improvements

WHEREAS, the Board of County Commissioners did, on September 16, 1991, accept Irrevocable Letter of Credit No. 877639-001-25 from the Columbia Savings in the amount of $3,768.99 with an expiry date of August 15, 1992, to cover public improvements necessary to serve Lots 1-20 in the Ken Caryl Ranch, The Valley, Filing No. 12, Phase II Subdivision; and

WHEREAS, the Jefferson County Department of Highways and Transportation has indicated, by memo dated July 29, 1992, that $3,768.99 would continue to be necessary for the completion of public improvements necessary to serve said Lots 1-20 within said subdivision; and

WHEREAS, the Subdivider has submitted an Amendment to said Letter of Credit No. 877639-001-25 from the Columbia Savings dated July 9, 1992, extending the expiry date to August 15, 1993, in the same amount of $3,768.99, with all other terms and conditions remaining the same; and

WHEREAS, the County Attorney's Office has reviewed said Amendment to Irrevocable Letter of Credit No. 877639-001-25 and has approved the same as to form.

NOW, THEREFORE, BE IT RESOLVED that the Amendment to Irrevocable Letter of Credit No. 877639-001-25 dated July 9, 1992, from the Columbia Savings extending the expiration date to August 15, 1993, with all other terms and conditions remaining the same, be and hereby is accepted.

BE IT FURTHER RESOLVED that said Amendment to Irrevocable Letter of Credit No. 877639-001-25 from the Columbia Savings be deposited for safekeeping, together with the original Letter of Credit, by the Director of Administrative Services.

Commissioner Stone seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

Commissioner John P. Stone AYE

Commissioner Marjorie E. Clement, Chairman AYE

The Resolution was adopted by unanimous vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
