RE:CHATFIELD BASIN AUTHORITY

AUTHORIZATION OF CHAIRMAN TO EXECUTE CHATFIELD

BASIN AUTHORITY AGREEMENT

WHEREAS, the Board of County Commissioners finds that intergovernmental cooperation to prevent degradation of the water quality in Chatfield Reservoir is necessary and desirable; and

WHEREAS, the Chatfield Basin Authority Agreement (hereinafter "the Agreement") will aid in preventing degradation of the water quality in Chatfield Reservoir; and

WHEREAS, the Agreement previously executed by Jefferson County in 1989 will terminate on December 31, 1992 and Jefferson County desires to continue the work of this Agreement and the Chatfield Basin Authority; and

WHEREAS, Jefferson County has the authority pursuant to C.R.S.

õ29-1-201 et. seq. and Article XIV, Section 18 of the Colorado Constitution to enter into intergovernmental agreements to carry out any functions which the County is authorized to carry out separately; and

WHEREAS, Jefferson County has the authority pursuant to C.R.S. õ29-20-104 to regulate the use of land to protect the environment; and

WHEREAS, Jefferson County has the authority pursuant to C.R.S. õ30-20-402 to construct facilities for the disposition of storm and surface drainage waters; and

WHEREAS, the powers granted to the Chatfield Basin Authority pursuant to the Agreement are all within the powers granted to the County by the aforesaid statutes.

NOW, THEREFORE, BE IT RESOLVED that the Chairman of the Board of County Commissioners is hereby and herewith authorized to execute the Chatfield Basin Authority Agreement.Commissioner Clement seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

Commissioner Marjorie E. Clement, Chairman AYE

The Resolution was adopted by majority vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
