Commissioner Stone moved that the following Resolution be adopted:
BEFORE THE BOARD OF COUNTY COMMISSIONERS
OF THE COUNTY OF JEFFERSON
Resolved, that the Board of County Commissioners appoints Faegre and Benson as special counsel for acquisition of right-of-way at 44th and McIntyre with the following limitations:
1.The appointment includes the authority to acquire the property in phases or as a single parcel, to seek and injunction prior to condemnation to allow entry onto the property for environmental testing, to retain such experts as are reasonably necessary to prosecute the case, and to negotiate settlement;
2.There is no authority to enter into settlement without the written consent of the County;
3.Authority is limited to acquisition of the property described on Exhibit 1 of the Agreement;
4.Faegre & Benson shall provide the County Attorney with copies of all documents filed with the court and keep the County Attorney apprised of the progress of the action; and
5.Faegre & Benson shall provide monthly billings to the County.
It is further resolved that the Chair is authorized to execute an Agreement with Golden Properties, Inc., providing for payment of the costs of such acquisition.

The Resolution was adopted by unanimous vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
