Commissioner Holloway moved that the following Resolution be adopted:
BEFORE THE BOARD OF COUNTY COMMISSIONERS
OF THE COUNTY OF JEFFERSON
STATE OF COLORADO

RESOLVED , that the Board of County Commissioners grants approval of Case Number 97015209WRP1, subject to the following conditions:
1. The private road serving the proposed subdivision will to the maximum extent feasible have an 18 foot width including shoulders and otherwise meet County private road standards.
2. The proposed road utilized for emergency access only, which is approximately 2,800 feet in length, must meet the following standards:
a. The minimum width of the road must be 14 feet wide, including shoulders. Six (6) foot long pull out lanes must be provided, where practical, at intervals approved by the Highways and Transportation Department.
b. The road will comply with the Jefferson County Zoning Resolution standards for cut and fill slopes or the applicant will obtain a variance from the Board of Adjustment.
3. The Board waives Section 3.6.8. of the Jefferson County Roadway Design and Construction Manual as it relates to the maximum grade allowed for that portion of the road that will serve as emergency access only. The Board waives this requirement and approves a maximum grade of 12 percent.
4. The proposed road utilized for emergency access only may be gated, but shall be equipped with a breakaway gate at the south end of the 2800 foot Emergency Access road to allow for use in an emergency situation.

5. The private internal road and emergency access road shall be maintained by a homeowner's association.
6. The property owner shall establish a mandatory homeowner's association and shall provide a mechanism to assure adequate funds are available to maintain the emergency access road and the private internal road.
7. The Board grants a waiver of Section 1.2.1.2., Part IV, Section 1.2.1.4., Part IV and Section 3.1.2.2., Part II of the Land Development Regulation, which requires improvements on Callae Drive and Red Cloud Drive.
8. The Board grants a waiver of Section 1.3.4.3., Part I of the Land Development Regulation which requires paving of roads internal to the proposed subdivision.
9. Conditions of approval numbers one (1) through six (6) shall be shown on the face of the plat as a plat note.
Commissioner Stone seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:
