Commissioner Holloway moved that the following Resolution be adopted:

BEFORE THE BOARD OF COUNTY COMMISSIONERS

OF THE COUNTY OF JEFFERSON

STATE OF COLORADO

RESOLUTION NO. CC98-349

WHEREAS, on November 3, 1986, the Board of County Commissioners of Jefferson County granted a Certificate of Designation to RPS, Inc. to operate a solid waste disposal site approximately at the northeast corner of Highway 93 and Leyden Road; and

WHEREAS, On April 4, 1989, said Certificate of Designation was transferred by resolution no. CC89-265 from RPS, Inc. to Landfill, Inc.; and

WHEREAS, Landfill, Inc. merged into Browning-Ferris Industries of Colorado, Inc.; and

WHEREAS, on February 16,1993, the Board of County Commissioners changed the permittee name on the Certificate of Designation from Landfill, Inc. to Browning Ferris Industries of Colorado, Inc.; and

WHEREAS, Browning-Ferris Industries of Colorado, Inc. has merged into and transferred all its obligations and liability under the Certificate of Designation, to BFI Waste Systems of North America, Inc., effective on September 30, 1997.

NOW, THEREFORE, BE IT RESOLVED that the permittee name on the Certificate of Designation shall be changed from Browning-Ferris of Colorado, Inc. to BFI Waste Systems of North America, Inc.

Commissioner Lawrence seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

Commissioner Michelle Lawrence, Chairman AYE

The Resolution was adopted by majority vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
