WHEREAS, Chatfield Commercial Center Partners and Lumbermen's Investing Corp. did file an application with the Planning Department of Jefferson County to rezone the herein described property in Jefferson County from Commercial-One Zone District to Planned Development Zone District; and

WHEREAS, public hearings were held by the Jefferson County Planning Commission on April 8, 1998 and May 6, 1998, at which time the Planning Commission recommended denial of the above application;

WHEREAS, after notice as provided by law, public hearings were held by this Board on April 28 and May 26, 1998, at which time this case was continued to June 2, 1998 for decision only; and

WHEREAS, based on the study of the Comprehensive Plan, recommendation of the Jefferson County Planning Commission, comments of the Jefferson County Planning Department, comments of public officials and agencies, and testimony and written comments from all interested parties, this Board finds as follows:

1. That proper posting, publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners of Jefferson County.

2. That the hearings before the Planning Commission and the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at those hearings.

3. That the proposal will be in substantial conformance with the South Jefferson County Community Plan if there is a limit on the total nonresidential development of 68,000 square feet and the written restrictions in the Official Development Plan are revised to address certain mass, scale and design issues. The proposal will then meet the Arterial-to-Arterial and the Infill policies by providing both residential uses and nonresidential development on a scale that will be compatible with surrounding uses. The overall proposal for mixed-use development substantially conforms to most other major policies in the South Jefferson County Community Plan as much as practicable within the constraints of the site.

4. That the proposed land use is compatible with existing and allowable land uses in the surrounding area in all directions because the residential component is compatible with the surrounding single family residential uses, and the applicant will revise the written restrictions in the Official Development Plan so that the nonresidential component will better conform to the surrounding development.

5. The subject property is located in the Meadowbrook Water and Sanitation District. The subject property will also be served by West Metro Fire Protection District.

6. That no known commercial mineral deposits exist upon the subject property.

7. That for the above stated reasons, the applied for rezoning, as conditioned below, is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the residents of Jefferson County.

8. That each of the factors set forth above is adequate independently to support this resolution.

NOW, THEREFORE, BE IT RESOLVED that Rezoning Application Case No. 97015198RZP1 to amend Jefferson County Zoning Map No. 17 to rezone the Commercial-One Zone District to Planned Development Zone District for the following described unincorporated area of Jefferson County, be and hereby is APPROVED, subject to the following conditions:

1. The applicant shall revise the written restrictions in the Official Development Plan to reduce the gross square footage of leasable area for nonresidential uses to a maximum of 68,000 square feet; to resolve concerns identified by staff in their written comments and during oral testimony relating to the mass and scale of the nonresidential development and design issues; and to address other issues identified in staff comments dated April 28, 1998. The applicant shall not be required to relocate the nonresidential uses from Use Area 11 to West Chatfield Avenue.

2. Revisions shall be made to the Official Development Plan graphic in accordance with the red-marked print.

3. The revised Official Development Plan shall be recorded after the Board of County Commissioners receives written confirmation from staff that the revisions to the Official Development Plan graphic and written restrictions are satisfactory.

Commissioner Lawrence seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

The Resolution was adopted by majority vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
