Commissioner Holloway moved that the following Resolution be adopted:

OF THE COUNTY OF JEFFERSON

Zone District: Residential-One A
Purpose: Special Use to allow a foster home for up to 12 teenage boys
Approximate Area: 0.24 Acre
WHEREAS, Ching-Hsiang Chen and Jing-Fen Chen did file an application with the Planning Department of Jefferson County for authorization of a special use permit on the herein described property in Jefferson County which is located in the Residential-One A Zone District; and
WHEREAS, a public hearing was held by the Jefferson County Planning Commission on November 4, 1998, at which time the Planning Commission did, by formal resolution, recommend DENIAL of the subject special use application; and
WHEREAS, after notice as provided by law, a public hearing was held by this Board on November 24, 1998; and

WHEREAS, based on the evidence, testimony, exhibits, study of the Comprehensive Plan, recommendations of the Jefferson County Planning Commission, comments of the Jefferson County Planning Department, comments of public officials and agencies,
and comments and testimony from all interested parties, this Board finds as follows:
1. That proper posting, publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners.
2. That the hearings before the Planning Commission and the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at those hearings.
3. That the requested special use is not in conformance the Special Use Criteria of the Zoning Resolution. The applicant has indicated he would like to have up to twelve children. Serving that number of children would require support services for deliveries, trash removal, and human services visits that would not be compatible with a residential neighborhood. In addition, the proposal with up to twelve children has the potential to produce unacceptable traffic impacts.
4. The Board of County Commissioners finds that housing six children in the home would be compatible with the residential character of the neighborhood. The Board also finds that limiting the special use approval to the proposed operator of the foster home, Arley Campbell, so that a group home is not a perpetually allowed use is necessary to maintain the residential character of the neighborhood.
5. That for the above-stated reasons, the applied for special use, as conditioned below, is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the residents of Jefferson County.
6. That each of the factors set forth above is adequate independently to support this resolution.

NOW, THEREFORE, BE IT RESOLVED that Special Use Application No. 98015253SUP1, located within the Residential-One A Zone District for the following described unincorporated area of Jefferson County be and hereby is GRANTED subject to the following conditions:
a. The number of children placed in the home shall be limited to six.
b. Special use approval is limited to operation of the foster home by Arley Campbell. Approval shall expire if and when the home is no longer occupied by Arley Campbell.
Commissioner Lawrence seconded the adoption of the foregoing Resolution. The roll having been called, the vote was as follows:

The Resolution was adopted by majority vote of the Board of County Commissioners of the County of Jefferson, State of Colorado.
