Tips for Handling Complaints
Non-performance on contracts. You must send a written complaint letter to the company and request a specific resolution to the problem. Two copies of the letter should be sent, one by certified mail and one by regular mail. The bottom of your letter should say "two copies sent, one by certified mail, one by
regular mail" to prove a company representative received notice. Request a response from the company by a certain date. Remember to keep a copy of your letter and log all calls between yourself and the merchant. If your complaint has not been resolved after writing this letter you can call 303-271-6931 for advice. We may request that you fill out a complaint form if we have jurisdiction over your problem. If we do not have jurisdiction we will refer you to an appropriate agency.
If your complaint falls within our scope, we will request copies of all of your paperwork (contracts, front and back of cancelled checks, letters, third party statements, etc.). You also will need to fill out a complaint form or provide a detailed chronology of events.
Partial Performance on Contracts. Follow the procedures for non-performance. Please understand that partial performance cases are usually civil and our involvement in these cases is limited. See the Civil Complaint section in this Web site.
Alleged criminality in car repairs. An independent, third party mechanical inspection of the vehicle and the replaced parts, at the owner's expense, is required to prove these cases.
Send the company a complaint letter and enclose a copy of the third party report. Ask for restitution and reimbursement of your expenses and request a response by a certain date.
Call the Economic Crime Unit at 303-271-6931 if your efforts fail to produce results. Please bear in mind that the District Attorney's Office cannot request reimbursement for damages. Those awards can only be obtained through the courts. For more information see vehicle repair in this website.
