The Diversion Council is comprised of trained community volunteers who meet monthly to consider client referrals that are considered “exceptions” to the Adult Diversion Program’s normal acceptance criterion. Defendants charged with crimes that would normally be ineligible for diversion, but whom the district attorney believes do not constitute a community safety risk, are considered by the diversion council for acceptance onto the Adult Diversion Program.
The members of the diversion council include representatives from local police agencies, the district attorney’s office, and citizen volunteers. In 2010, 173 exception cases were reviewed by the diversion council, with the following results:
Exception Referrals in 2010: 173 Not Accepted: 20 Failed to Appear: 7 Client Refused: 5 Offer Withdrawn: 4 Exception Cases Accepted: 137
