    Bad Checks Complaints


    The District Attorney's Office launched the Bad Check Restitution Program View exit disclaimer policy page for links to third-party websites. to help merchants with losses from bad checks. The program works in conjunction with American Corrective Counseling Services. View exit disclaimer policy page for links to third-party websites. First-time offenders are given the opportunity to avoid criminal prosecution by attending a mandatory, eight-hour intervention class and by paying restitution.

    A bad check is eligible for the program if:

    • The amount of the check(s) is less than $5,000.
    • The check was received in Jefferson or Gilpin County.
    • A courtesy letter was sent to the check writer, offering the writer 10 days to make the check good.
    • The complaint is submitted to the program no earlier than 31 days after the check was written and no more than 90 days after the date on the check.
    • A photo ID was recorded at the time of the transaction.

    A check is ineligible for the program if:

    • It is stolen.
    • It is postdated or made to cash.
    • Both parties knew there were insufficient funds in the account at the time of the transaction.
    • It is a two-party, stop payment, rent, government issued, payroll or travelers check.
    • The identity of the writer is not known.
    • There is no amount, date or signature on the check.
    • A bank has not processed the check.

     

    If your check is ineligible for the program, you may still have remedies under the law. First, check with the sheriff or police department where the check changed hands. Determine if that organization has a Check Fraud Unit and if your check meets that agency's check fraud criteria. If the check does not meet the criteria, you can still sue in Small Claims Court or mediate through the Mediation Services Program. Generally, you will want to sue the check writer in the jurisdiction in which that person resides.
