    Robert McGhee Sentenced to Community Corrections over DA’s Objection

    Robert John McGhee, DOB: 2-25-56, was in court today to be sentenced for the vehicular homicide of a 48-year-old Wheat Ridge man in November, 2014. McGhee hit and killed John Robert Gilmore, DOB: 10-5-66, as he was walking home from his first day at a new job.

    A visiting judge sentenced McGee to five years in community corrections and one year in jail, to be served at the community corrections facility. This was over the prosecutor’s vigorous argument for a prison sentence.

    “This is a travesty,” said District Attorney Pete Weir, “Mr. Gilmore’s family has suffered great loss and was heartbroken today at the sentencing when Mr. McGhee was not sentenced to prison. A community corrections sentence for someone who drives drunk and kills someone is not justice.”

    “Although Mr. McGee was given a five year sentence to community corrections, that means that he will be in a residential facility for about six months and then be released into the community,” said Weir, “This is unconscionable.”

    McGhee could have faced a prison sentence of up to twelve years.

    On November 23, 2014, Wheat Ridge Police were called to 38th Avenue and Tabor Court, where they found Mr. Gilmore lying in the street. Mr. Gilmore was very seriously injured and was transported to the hospital where he subsequently died from his injuries.

    McGhee’s BAC was .140, almost twice the legal limit.

    A Jefferson County jury found McGhee guilty of Vehicular Homicide and DUI in October, 2015 following four days of trial.
