    Police Officers Indicted for Embezzlement and Forgery


    (Golden, CO – April 19, 2017) A Jefferson County Grand Jury has returned a 35-count indictment accusing two police officers of Attempt to Influence a Public Servant, Forgery, Embezzlement of Public Property, and Theft. Leonard Portugal, DOB: 12-29-69, and Ricardo Hernandez, DOB: 10-1-73, both officers with the Mountain View Police Department, have been indicted on multiple counts.

    The Mountain View Police Department participates in three Colorado Department of Transportation (CDOT) grants: Law Enforcement Assistance Fund (LEAF); High Visibility Impaired Driving Enforcement (HVE); and Click it or Ticket (CIOT). The purpose of the grants is to provide overtime for peace officers for patrol work in the Town of Mountain View.

    According to the indictment, the alleged criminal conduct occurred between January, 2015 and June, 2016. Portugal and Hernandez are accused of submitting falsified Daily Field Activity Reports (DFAR) and time sheets associated with overtime hours provided by grants funds. As a result of falsified grant hours, Portugal was paid $24,935 of public monies that he did not earn and to which he was not entitled. Portugal is accused of having submitted at least 31 DFARS and time sheets claiming grant hours he did not work. Hernandez was paid $2,735 for hours he did not work as a result of falsified grant hours.

    According to the indictment, Portugal was responsible for applying for the grants, organizing officers to work the overtime shifts, and reporting the statistical information to CDOT as required. Each peace officer was responsible for reporting their overtime hours related to grant shifts on time sheets. Those hours were to be reviewed by the Chief of Police or his designee, and then went to Portugal to compile statistics. In some situations, the time sheets documenting grant hours went directly to Portugal.

    The indictment was returned on April 18, 2017. Portugal and Hernandez turned themselves into the Jefferson County jail on April 19, 2017 and are being held on $10,000 bond.
