Planning Commission

The Planning Commission is a group of volunteers appointed by the Board of County Commission to hear land use cases. The Planning Commission meets every Wednesday except the third Wednesday of the month. The first and second Wednesday hearings start at 6:15 p.m. The fourth and fifth Wednesday hearings start at 1:45 p.m. Agendas are posted at the beginning of each week. The Planning Commission typically makes a recommendation on a land use case which is then sent to the Board of County Commissioners for a final decision. On such cases as preliminary plats, site approvals, and community plans, the Planning Commission is the sole decision maker. Board of Adjustment

The Board of Adjustment (BOA) is a seven-member board, created by State Statute and appointed by the Jefferson County Commissioners. The BOA has the authority to grant variances and/or special exceptions to established zoning regulations, if an adequate hardship or practical difficulty has been demonstrated. When a case is scheduled for hearing before the BOA, a public notice sign is posted on the subject property for a minimum of 15 days, and written notification is provided to all adjacent property owners. Public input is encouraged. Variances (e.g., reduction of required setbacks or lot size, or increase in height, etc.) run with the land, while most Special Exceptions (e.g., temporary structures, home occupations, etc.) are granted for a specified length of time, and require rehearing and renewal upon expiration.

It is not within the purview of the BOA to change land use, and therefore variances, when granted, do not constitute a rezoning. Decisions of the BOA are final, and the appeal process is through District Court.

The BOA usually meets on the first and third Wednesdays of each month at 9:00 a.m. The Board votes on a schedule, which has hearing dates on other Wednesdays to accommodate weeks with holidays and to avoid back to back hearings. A draft agenda will be posted approximately two weeks before the hearing, listing the cases to be heard, but not indicating Consent or Regular agenda. The final Agenda will be posted approximately one week before the hearing. Public hearings are conducted in Hearing Room One of the Jefferson County Administration and Courts Facility, located at 100 Jefferson County Parkway in Golden. Board Of Adjustment Membership
Regular and Associate members of the Board of Adjustment are appointed by the Board of County Commissioners for three-year and one-year terms, respectively, and serve on a voluntary basis. The Board of Adjustment is comprised of five Regular members and two Associate members.
