  •  Foreclosure

Foreclosure, the forced sale of a piece of property to repay a debt, is conducted by the Office of the Jefferson County Public Trustee on Deeds of Trust containing a power of sale. Colorado Revised Statutes specify the procedure for conducting the foreclosure, which must be followed exactly.

The Deed of Trust is an agreement between three parties:

    • The Grantor (owner)
    • The Public Trustee (who has the power of sale)
    • The Beneficiary (lender)

For more information on the statutes, visit the Colorado General Assembly websiteView exit disclaimer policy for links to 3rd party websites Please use due diligence to determine any and all laws that may apply to any actions you may take.

NOTE: Due to significant changes in the law, the way in which a foreclosure is processed depends on the date the Notice of Election and Demand (NED) was recorded by the Jefferson County Clerk and Recorder. To determine this date, visit our Foreclosure Property Search page. After you have entered information about a specific property in foreclosure the date is listed in the “NED” date window under "Basics."
