Filing a Foreclosure
Commencing a foreclosure in Jefferson County
Below are
acceptable methods for filing:
All filings will be proofed for completeness and accuracy in accordance with the referenced statutes, and if complete and accurate:
- The Notice of Election and Demand (NED) will be recorded within ten business days.
- You will receive a notice from us when the filing has been accepted.
- Documents electronically recorded and required to be sent back will be sent via email electronically.
- If an error is found, the entire file will be rejected for the corrections to be made. When the file is complete and accurate, the NED will be recorded ten business days from the receipt of the corrected filing.
- A deposit of $650.00 or the amount of the fee permitted pursuant to 38-37-104(1)(b)(I), whichever is greater.
- Please include instructions with your initial packet for one of the following in the event that we need to return the original documents:
You will send a self addressed stamped envelope of sufficient size for documents.
You will send a prepaid label for shipment (FedEx,UPS, etc.).
If you prefer to have the documents returned by courier, please advise us of the procedure to use.

Filings must meet all the statutory requirements of 38-38-101 (1) - (10). The following are in addition to the statutory requirements:
- Memo of Understanding to establish an ACH account for payment of fees. Please contact our office for instructions.
- Adherence to our naming conventions click here: Naming Conventions
- Scanned documents must be complete with regard to the number of pages, and each page needs to be complete and legible.
- Social Security Number for the borrower must be redacted.
- Mailing list must match the names in the system. The Public Trustee is no longer required to be on the Mailing List.
- A legal description that is more that (4) lines long must be submitted as an exhibit and scanned as a separate document.
- Attorney's name, bar number and phone number must be legible on the NED.
- If we can't verify the address from the Deed of Trust, please don't add it to the NED.
- Recordable documents (NED and OAS) must be submitted in TIF file format.
TIF image requirements are:
- Scanned black and white
- Scanned at 200 dpi
- Scanned in portrait model
- Images captures as multi-page TIFS
- Group IV TIF compression
Note: The Combined Notice for mailing and publication will be created from our software unless you add language that is not in our database. If there aren't fields in our system for the added language, you will need to provide a Combined Notice in Word format. Examples of fields not in our software: loan modifications and recording in different counties. The Combined Notice is in Word format so the information can be added as it appears on the NED. The Certificate of Purchase and Confirmation Deed are generated by our software. That information will not appear, so it must be included as a reference in the legal description field.

Paper Submission
Filings must meet all the statutory requirements of 38-38-101 (1) - (10). The following are in addition to the statutory requirements:
- A deposit of $650.00, or the amount of the fee permitted pursuant to 38-37-104 (1) (b) (I), whichever is greater.
- All documents must be originally signed.
- Social Security Number for the borrower must be redacted.
- Self-addressed envelopes for each name on the mailing list or Avery label format to create labels. The Public Trustee is no longer required to be on the Mailing List.
- A legal description that is more that (4) lines long must be submitted as an exhibit, and scanned as a separate document.
- Attorney's name, bar number and phone number must be legible on the NED.
- If we can't verify the address from the Deed of Trust, please don't add it to the NED.
- A separate document stating the name and address of the current owner.
- Please indicate in the cover letter if the homeowner is not eligible for deferment.
- Do Not send Statutes. This office provides them.
